Actually, I was born in India, I moved to Canada when I was 10 and then became a naturalized Canadian Citizen (I do live in Ontario now). Not sure if that makes any difference.

The original birth certificate states my dads name, so if I have to present that during the interview stage, I assume it would be smart to just list my biological dads name and not my step dad. The only reason that I can think of to put my step dad's name is because all other documents (my immigration purposes when I came, school records, etc) all have my step dads name.

FYI as a naturalized Canadian, especially from India, you may be put into AP after your interview. Be prepared for that.

Onto your question, you will not need your step-father's name for anything. They want your biological father's or none at all and your biological mother's or none at all. It's good that your original birth certificate has your parent's name on it, I can imagine that would have been difficult to get if you didn't already have it.

Sorry, what does AP stand for? i searched but couldnt seem to find the definition for it. It seems like they ask for more information if youre put in AP?

thanks for answering the name question, i just realized i put my step fathers name on our marriage certificate, not sure if that makes a difference on how the application needs to be filled out when it comes to father's name. Can I not, in a separate sheet explain the whole dad, step dad situation?

Administrative processing. It's very common for men in middle eastern countries as well as Indian especially if you have a common name. They do extra checks at that time.

You probably should correct your marriage certificate should it say your parebts names on it and also send a letter mentioning the mistake should you choose to send before the marriage certificate is corrected.

Yea so i was just reading some other threads, and i should update the marriage cert. I will call them and see how long it takes.

If it takes months to update this info then I will just do what you suggested. Send the application and give more information explaining why their is a difference on the marriage certificate and all the other papers

oh another question (i am sorry for all these questions but just being cautious)

one of the section in the 130 form states "has your relative ever been in an immigration proceeding". So if i immigrated from india to canada, would i answer yes? or is it specifically talking about US immigration proceeding?

The options given that i can choose for that section are "removal" " Exclusion/deportation" "Rescission" "judicial proceedings"

But if i answer yes to this question then none of those relate to me

That question is specifically asking about US proceedings, not Canadian proceedings. Furtheremore, if you have never been before a US Immigration judge, then none of that applies to you.

A general question, instead of changing the marriage certificate, can we do a affidavit to show why the name of the certificate is my step dad?

What good what that do? It would be the same as the letter you plan on writing. In the USA things that are notarized are only showing that someone watched you sign the piece of paper, not that the information contained in this piece of paper is correct or factual. Just write the letter and get the darn thing fixed as it's wrong. Your stepfather may be the man you consider your father, but at least in Canada, they use the names as a matter of public record and genealogy. If the marriage certificate is from the USA, well then it really doesn't matter since there is no federal marriage database.

True true. Well since I'm back in Canada my fiancée will be going in today to see how long the change will take.

Just called Canadian governments various agencies and they had my step dad's name on all records. But like you said that's probably cause of public records and whatnot.

I know I sound very paranoid but it's just a weird situation, all the papers in Canada show my step dad as my dad (my dad passed away in India) and it's only my birth cert that shows his name so that's why I'm a bit more confused I suppose.
