Will be applying for Naturalization with Criminal Record

Hi Everyone!

My husband is 20 years Greencard holder. He is planning to apply for Naturalization within this year. but we have several problems though. please help us out.

1. My husband has a criminal record for attempted robbery when he was 18 years old (his 32 now) and he was imprisoned for 2 days; and his drivers license was suspended because of illegal racing during his younger years. Is he still allowed to be Naturalized Citizen?

2. My husband left the US last June 2013 and returned on August 2013 ( 2.5 months) because we are getting married at July 2013. Is it true that he have to wait for 3 months prior to his return to the u.s. which will be Nov 2013 before starting to apply for Naturalization?

I can't give you a really good answer on the first question but I would suggest him to get a lawyer just so if he gets bumps in the process the lawyer would know what to do instead of your husband getting a headache. The second question is no he doesn't have to wait 3 months before he can apply for citizenship. I hope he fulfilled the requirement for living in the US for the past 5 years. Good luck.
