Timeline

I know it does not ask in the I-129F form for her birth certificate from Peru, but I am just a bit nervous I suppose. I am planning on sending this with. But would be better if I did not have to. Do I have to??

One more question, the translation form just says to have some attest to being fluent in that language and English. Is that all they have to provide is their signature?? Or do they also have to provide some form saying why they are qualified. ie. a teaching certificate in Spanish.

No you do not have to send your fiancee's birth certificate nor the translation of it along with the I-129F. It is only needed during the Interview later on down the line. Relax..... You only need to send a copy of YOUR birth certificate (back and front) if you are USC by birth.

About the translations.... I myself am not really sure about that. Though I have read that anyone fluent in both languages could translate the docs for you, but I think I'm gonna have mine translated by one of the Sworn Translators listed by the US Embassy. Maybe you could e-mail the US Embassy in your fiancee's country to get the list of Sworn Translators in Peru.

Two things, it is not requested and generaly not needed. But if you do send it be sure to send a translation with it, others have gotten an RFE for not sending a translation.

Hey - someone else for a K1 in Peru!! Yay :dance:

You do not have to send her birth certificate in - but you will need it for the interview - certified by RENIEC (there is an office in Lima).

As far as the translations, anything that is in Spanish must be translated by a certified translator. The I-129F form says, "Any foreign language document must be accompanied by a full English translation that the translator has certified as complete and correct, and by the translator's crtification that he or she is competent to translate the foreign language into English." There are many companies that offer cerified translations, just look in your local phonebook.

May 6 - Received an email response saying things were progressing normally but that waiting times might be longer

my fiance is from peru too! and we did it through a lawyer and had to sent his birth certificate, which is quite a process to obtain...or so it was for us in peru...it's more complicated for the peru embassy as it has to be made ok for international use and you have to go through various offices to get it stamped and all! good luck!!!!

Timeline:

Oct. 6 - Packet mailed by lawyer to CSC

Oct. 10 - NOA1 Received

and still waiting

May 19 - Set wedding date that I hope we don't have to change

we didn't need to send my BC with the I 129F, it was only needed at the embassy interview, but i had to have it translated by a sworn official translator, they were very clear about this, so i'd have it done by a profesional to avoid problems and delays.

It only specifies a copy of the USC's birth certificate or complete passport to establish citizenship and nothing about the beneficiary. Claudeth did take her original BC to the interview but they didn't ask for it.

Yes and other VJ'ers have received an RFE for it. So IMHO the guides are lacking and should include anything someone might receive an RFE for. People seem to automatically assume the guides are a catch all, they're not. I sent my fiancee's BC on good advice.

Why do service centers sometimes RFE for something that's not required as per the instructions on their own forms? That's what really confuses me. It's not required, so why RFE for it, and if it is required it should be in the instructions and EVERYone that doesn't send it should get RFEd, not just some random people. :blink:

I think the way to look at it is that the instructions' list is a minimum; if they want more information, unfortunately the burden of proof is on us, the petitioners... After all, we're still not entitled to marry just anyone.

Sometimes, though, from what I've read here it seems as if it all depends on the mood of the adjudicator that day, whether they've had their coffee yet, etc.

I'm not sure. I mean, if they don't list it, then they can't expect it to be sent. So why delay the case to get something that you didn't ask for in the first place? If they need it in order to adjudicate one couple's petition... then... why don't they need it to adjudicate another couple's petition? What does the foreign fiance(e)'s birth certificate even accomplish for them, anyway? They're supposed to be running background checks, making sure all the paperwork's done, making sure the couple has met in person over the last 2 years, etc. etc.... I don't see how the foreign fiance(e)'s birth certificate even fits into that picture. And if it does fit in somehow, then I don't understand why it's needed for some couples and not others, and it's not needed enough for them to list it in the instructions as a requirement.

It's just so weird. I mean, I can understand if a couple includes it in a foreign language and they RFE for an English translation... the couple created the problem there, by sending an untranslated document. But RFEing for the foreign fiance(e)'s birth certificate out of the blue... I just don't get.

Oh, and in addition to the adjudicator's mood and coffee status, don't forget the time of the month of the ladies. :lol:
