Here is a story for anyone who thinks the majority of gun sales at a gun show happen without a background check (hint: nearly all transactions at gun shows are done by licensed dealers and include a NICS background check).

Lamont Reaves, 27, who is a convicted felon, apparently tried to get several vendors to sell him a gun at a Virginia area gun show without a background check.

Anti gun advocates would have you believe that Reaves would have been able to easily find a gun for sale without a background check at one of those evil gun shows.

However, Reaves was denied by multiple vendors, and several of the vendors actually notified a state trooper working the gun show who took Reaves into custody. Charges were filed after it was found Reaves was a convicted felon.

According to The Times Dispatch,

[state Trooper] Sottile and other state troopers have developed a rapport with firearms dealers at Virginia gun shows, and those relationships have helped reduce illegal gun sales, authorities said.

“Licensed gun dealers play a major role in stopping illegal gun purchases, especially straw purchases,” Sottile said. “In my experience at gun shows and licensed firearms storefronts throughout the Richmond area, dealers have contacted me if they suspect someone — through his or her conversation with the customer or the customer’s odd behavior — is attempting to make an illegal purchase.”

“I can’t thank the dealers enough with whom I work with for their help in aiding in criminal prosecution,” he added.

Reaves was sentenced to 9 months in prison for attempting the illegal gun purchase.

So I guess our current system does work when it’s actually enforced and gun shows aren’t free for all black markets for criminals buying guns after all (not that we didn’t already know that).

Your story about the truth gets little attention from those that claim to be interested in it. Who'da thunk it?

The only problem with the existing system is the lack of enforcement of current laws. When current laws, supported and promoted by the NRA in lieu of the "Brady Act's" original intent, are enforced the result is very effective. The problem is that only a very tiny amount of the felons attempting to purchase firearms are ever prosecuted, despite it currently being a crime in itself and often a violation of paraole and probabtion orders.

I have often suggested that dealers should delay the prospective purchaser until police can arrive to arrest him. The downside is that this puts the dealer at risk of keeping a known felon in his premises until police arrive and it really is not his responsibility to take that risk. But there should be a way that the attempt to illegally purchase a firearm results in an immediate arrest. It should not be a rare thing. Banks have silent alarms, perhaps the same should be employed by gun dealers to summon police. It may even be easier to enforce in gun shows, since as long as the suspect is in the venue you do not need to "delay him".

Also intersting is the fact that people who wish to restrict our rights are not interested in a system that WORKS, only one that restricts rights.

I would have expected many of the anti-gun people here, who claim to ONLY want to deny firearms to "the wrong people" would be overjoyed at this news and posit many positive comments.

Look at that biker in NY city who terrorized the asian.family in their car, He had over 20 arrest including dealing drugs . They found a loaded pistol in his home. Supposed to be what a 2 year mandatory sentence for possession without a permit. Never even charged him. Were prints even ran to see if he handled the gun? Laws on the books that are never enforced. NY passed the safe act to harm law abiding gun owners. Looks like they refuse to arrest people who need to be arrested.

We need more laws making crime a crime. As soon as this happens, the crime rate will drop because criminals will suddenly start obeying the law. Driving while intoxicated used to be legal, but as soon as it became a crime, bam! No more people drank and drive. Illegal drug use was made illegal, and poof! I'm sure you've all noticed how the drug problem vanished, almost overnight. People will not use cocaine, heroin, meth, etc now since it is illegal. These are just a few areas where the law has eliminated major problems.

New York Criminal Possession of a Firearm (NY PL 265.01-b(1))

As of March 2013, what used to “only” be a misdemeanor crime has now become a felony offense in New York State. If you are arrested with an unlicensed or unregistered firearm (a pistol or revolver, for example) in New York City, Queens, Manhattan, Brooklyn, White Plains, Yonkers or any other municipality, the police and prosecutors can arrest and charge you for violating New York Penal Law 265.01-b(1). Adding to the list of what is arguably to strongest and most severe weapon crimes and laws on the books, PL 265.01-b(1) is an “E” felony punishable by a sentence of up to four years in prison whether you have a criminal past or not. Make no mistake. You unequivocally need the assistance of a firearms and weapons lawyer or a criminal defense attorney sooner rather than later should you face this crime. Judges and prosecutors in New York City and suburban jurisdictions will certainly entertain setting bail the first time you appear in court whether or not your firearm is licensed out of state or in a New York, but outside New York City.

Although the pistol or revolver you possess (this possession may also be constructive where it is not on your person) may be loaded, as noted above, it need not be. The gun need only be operable. If it is in fact loaded, the ammunition or bullets can be stored separate and need not be actually in the firearm, the crime can go from bad to worse. Possession of loaded firearms is punishable by a mandatory minimum of five years in prison and as many as fifteen years in jail.

Chance — who has 21 prior arrests for charges ranging from drugs to robbery to gun possession — was ordered held in lieu $100,000 bond or $75,000 cash.

Records reveal junk justice left him free to raise hell after an April drug deal near a Brooklyn school. Chance had allegedly sold cocaine through a middleman to an undercover cop in Bed-Stuy. A warrant was later executed on an apartment Chance was in and turned up cocaine, pot and a loaded handgun.

Chance was busted and hit with gun and drug raps and faced more than 25 years’ prison.

But Brooklyn prosecutors dropped the gun rap when Chance was indicted. A source said the charge was weakened by the fact that Chance — who allegedly admitted the pistol was his — had not been the target of the search for the gun.

Under a sweetheart plea bargain overseen by Brooklyn Criminal Court Judge Suzanne Mondo, all the remaining felony drug charges against Chance were also dropped.

He wound up with a one-year conditional discharge for misdemeanor pot possession and was given 20 days of community service.

Chance also received a six-month suspension of his driver’s license — which cops say he ignored when he joined in last week’s 300-biker Hollywood Stuntz ride that ended with the attack on Lien.

Is this the one from NJ state? If so, NJ state failed, not NY State.

Who wouldn't be happy about a convicted felon not getting a gun? Does that really have to be said? In that case, I'm happy that many people out there are alive, productive, satisfied with their lives, and law abiding (there, that should cover all the bases in the future in case my personal emotions over one individual case ever come into question again).

I don't remember anyone saying that a majority of gun show sales go without background checks. If memory serves, the complaint was simply that a loophole exists that allows a mechanism for people to obtain guns without said background check, and that loophole should be closed. This story doesn't say the loophole doesn't exist, it just says that the guy went to sellers who participate in background checks, one (!) of which turned him in.
