OP, u r over analyzing.

1. See pro-se attorney about benefits with your PF

2. Get help of someone who knows how and File the 5 forms required - U'll receive EAD card in one month

3. Answer the RFE properly, and your I-360 is about to adjudicate

Anyone who tells u your I-360 is far from assured, is far from modern (this year) experience. All properly submitted I-360 get approved right now. By waiting with I-485 and I-765 U'll just waste a few months of productive work time due to alternative processing procedure sequence. If I submitted I-485 together with I-360, I'd have GC in hand by now. I didn't, only because I wasn't guaranteed EAD. But you have proof of spouse's USC - so u r guaranteed 1 year EAD. Nothing to postpone for, your lawyer did you disservice at the outset

Got it. I guess I have to send the ead and i485 together with the response to this 2nd rfe. When you 5 forms..may I know the form numbers pls? I765, i485, i360 has already been filed, so which are the two extra ones?

OP, it so happens that sandranj mentioned all (5 forms by name) in her post inside my benefits topic. Don't tell me u still haven't read that whole topic

I read it today, its too complicated and I believe our cases differs. You've been in US since 99 unlawfullly? And I'm less than 5years.unfortunately the judge ruled against you(so sorry to hear that,but I applaud your effort) So I guess I was denied benfits cos the woman said I ought to have lived legally with a green card in the US for 5years.and I'm just 4yrs but legal. I can't revisit those benefits application cos they were depressing and time consuming, I'm more interested in my vawa at this point.maybe the benefit might be different in NYC but I dnt live there. This guys really just don't care about PF and are not interested in giving you benefits without a green card. I've had enough of it already but thanks- for your input

Very little of what u just said is correct, but I'll try to stick with only your current situation:

1. U can get cash, Medicaid and (CA substitute) food stamps going back to at least the date you brought your PF in, if not to the issue date of first PF notice.

2. Again, your I-360 approval is a matter of properly answering RFE. u shouldn't limit your efforts to just that.

But to be honest: everyone gets out of life what they want. Neither u nor children will starve, no such possibility on U.S. soil. If u think engaging a free attorney for financial assistance and a free attorney for immigration are both too much trouble - I understand. It took me multiple appointments and trips to get that - but praying and complaining of my bad luck is just not my cuppa tea. My best wishes to you, like everyone else

I understand we get from life what we want, if I could get a free attorney to process that for me I will be more than happy to get into it but I can't seem to find any..I will take the advice I'm getting from this forums and apply for both ead and i485 as I'm sending back my response to the rfe and I intend to answer it well. If I have any issues I will ask here and I'm so relieved I got a few people here that has a Good heart also and willing to help each other.also, if you insist I 'could' get those benefits? Then I might reopen the case if I can get a free attorney or over the phone re application cos driving to and fro the benefit office is no longer visible.

But what to expect from random blogging people, if officials charged to work with my family over a decade never helped... I mean almost a hundred different officials all collecting salary while talking to me - and none ever pointed me in the right direction. Hey good luck, and never give up no matter what

Yeah sad, but sometimes most of these officials only care about their salary. Thanks- for the wish.and I will never give up. I hope your own journey is going well? We are ALL in this together and the support everyone gets here is worth a million dollars.

Yup. I just think I messed up by not putting I-485 in earlier, way before I-360 decision. Now, I can't figure out what's delaying my transfer to local NY office. I did rush biometrics and Medical, but It looks like not having it all in one shot is causing different procedural sequence. Howtosurvive was approved later, but she already had her interview in NJ - and she had everything in together. Or maybe it's just NY...Anyone knows NY?

Well hang in there its almost over. I think they do it on purpose cos based on what I've read in the forums so far, time frames are so different, some people got approved withing 6mnths, some wait 15-20months, some cases gets transfered within weeks some take 3months etc.leaving people to just sit back and pray for nothing but a positive response for their case. I give God thanks- for everyday and everything. And I'm still hoping for the best.

Yeah the time frame varies but remember every time tgey read your file they either gonna approve deny or rfe. So if you give them every thing one time its tge best chance of getting it over with faster. My interview was less than two months from my vawa approval. And they transfer my case a day after it was updated but my actual i360 was approved on August 5 according to the hard copy. Hang in there besgirlever your good news is around the corner. Singledad 2usc ur interview is nearer than u think.

08/2012 Discussed my immigration issues with a lawyer

08/2012 Started gathering evidence

11/2012 Paid my deposit (forgot to sign documents)

01/2013 Signed documents

02/19/2013 Vsc received my application

02/22/2013 NOA mailed out

My lawyer has a prima facie never collected it Caz I don't need any benefit at this time.

03/05/2013 EAD mailed out (actual ead date, it will expire 03/04/2014)

03/08/2013 Lawyer received biometrics for 3/17/2013 (day after my edd, [expected due date] did early walking 3/12/13)

03/29/2013 Card in hand (lawyer received it abt a week earlier but I delivered so was unable to collect it)

Waiting for my i360 approval but I'm in no rush (good things come to those who wait)

8/14/13 i360 approved. :)

10/8/2013 aos interview. .. approved :)

10/9/2013 status adjust to lpr and welcome package mailed out.

8/15/2013 I484 transfered to local office. :)
