Our RFE was sent on Oct. 19th, we received it finally after an infopass appt on Nov. 13th. Do the 87 days start from when we actually received it or when it was sent, which was almost one month earlier.

I know it's best to send it in ASAP but that might not be an option until around Jan 10th.

SENT, they have no idea when you received it in order start the clock, they only know when the sent it.

SENT, they have no idea when you received it in order start the clock, they only know when the sent it.

In this case they do know when we received it because the status online was undeliverable and we had an infopass appt. in order to obtain it on NOv 13th.

I guess if it was sent in late Oct. then if we respond by mid Jan it should be ok anyways right?

I will rephrase... you have 87 days from the date it was issued.....

To be on the safe side, start the 90-day countdown from what ever the date on the RFE. Do your best to reply within that timeframe. However, if for any reason you are not able to do so then include a cover letter explaining your special circumstances and the problem with getting the RFE.

The online status regarding RFEs says that if you dont receive it within 30 days from the date of issuance then inform the USCIS. Hence, USCIS should consider this when determining your 90 (or 87) day deadline.

Thank you! The RFE we got at infopass is dated Nov. 13th and after the infopass we were able to have the original RFE sent to us which is dated late Oct. I'm sure they are aware that the original RFE was undeliverable for one month but I will still send an explanation when replying.

The reason we can't send it right now is because my brother our co sponsor just got a new job and is starting in Jan so we will get a letter from his employer in Jan and send that.
