Hi all!!

Would there be any way for me to get approved on my visa interview if my fiance's W2 shows he doesn't meet the income for household of 5? He earns about $25,784 annually and it requires that he has $27,570 for household of 5. Is there any way his mom be a co sponsor since they live in the SAME household. I've read that the US Consulate in Manila does not allow co sponsors for K1. What do we need to prepare?

I want to cry now..i called the Immigration Visa Unit and they said it will just be denied bec of insufficient income and that i'll be public charge..I don't know what to do anymore..We even have an immigration attorney, if we get denied we just wasted money for nothing... :( Help please...

K1 visa has only the 100% poverty guideline requirement...double check...

Hi Chuck&Jade, now this is confusing about the income requirement. I read comments and posts that 100% is the required requirement for fiance Visa but during the interview the consul would ask for 125% and seen some who got 221g cause they didn't reach the poverty level of 125%.

Which i am a bit nervous now, My fiance have no dependents/children. He petitioned me and my 2 kids so that would make it 4. (Me, Fiance and 2 kids)

On his ITR he got $28, 844 so we exceed the 100% for 4 but slightly short to reach the 125% poverty level which is $29, 439.

Now I would like to ask if were okay? My fiance is self employed and he only send me his 2012 ITR and form i134. Would that suffice?

Our interview is in two weeks. Just worried now. Thanks

Hey I'm new here and I'm sorry to ask that now but I thought maybe it's the right place for it now that you talk about it! How do you know how much is required to have?

Because I'm thinking right now if the tax papers are good enough for showing the support. My fiance just found a job this year in June, so she has no tax returns but we want to use her parents tax returns. She is living in a house with her daughter and her parents. So what would we need to have then?

I'm sorry but I really don't know where you got all the information how mayn money we need to prove them that it's good for us!

How many dependents does he have? If he he doesn't support anybody then you coming over woyld only mean 2 members of the household. If he lives with his family but but doesn't fully support them or spends for any of them then he currently should have 0 dependents. If he pitches in for the house bills, I still reckon that he only supports himself with 0 dependents. How many people does he support fully currently? That's the number of household members he has.

If he has kids, even if they don't live with him they are his dependents or so I hear. I have 4 including my fiance, and my co-sponsor is my stepdad, mom doesn't work so we have to meet guidelines for 6. I was told shoot for 125% not the 100%, since COs will often want to see the 125% due to the fact you will be AOSing a mere months after you arrive in the USA.

If he lives with other adult family members and no kids then it is just him and you :)

I was able to read from the USEM website that they only use 100% for the poverty guidelines but missed where that part is. and sometimes its their rule that is followed.. lets play safe, since it isnt enough ask your fiance to send his bank statment as consuls will do the calculations. so to hit 125% for 4 household $29,439 he must have a money on the bank atleast $3000...

USEM does, on occasion, accept co-sponsors with the K-1 visa, the co-sponsors has to be a relative... so mom is good. She will need to have income to meet or exceed the 125% requirement of the I-864P poverty guidelines for herself, you and your children if there are any. Both your fiance and his mom should complete the I-134 (and I suggest to also complete the I-864 for both as it has helped many times) plus supporting evidence = most recent tax return and W2. With all of that it may not be a slam dunk, but at least there is a good chance of having the co-sponsor accepted.

If you were going to try using assets to make up the shortage in income you would need 5 times the amount of the shortage. Now with that said I know of a few that tried to use assets and USEM did not accept the assets... so I would not count on that route.

What works for the Philippines may not work with another embassy, I was referencing U.S. Embassy Manila only.
