I got my I-751 recipe and it's stated that extension is for a year or untill GC not terminated. I also get letter for biometric which I have on 18th of this month. I wanted to travell abroad for 3 weeks after my biometric done but I am afraid that If decision was made while I am not in country or they ask for something while I am not in country, What will happen?



What's the normal processing time?


Am I allow to come back to country for apeal?

If the decision was to deny your ROC then it really does not matter whether you are in the country or not as they would start deportation proceedings on you or not let you back in. If you get an RFE (request for evidence) you have typically 90 days to respond. If you have an interview it will be after the bio appointment.

Those are the gloom and doom options. What will happen is you will go on your trip, have a good time and then return to the US before your case is completed. You are not going to be outside the US for that long so you really are not at risk of missing anything. Take along the original extension letter to use with your expired GC for re-entry into the US. If your current GC is not expired then use it. We received our GC 2 months after the 2 year GC expired, so about 5 months from submittal without an interview.

You haven't completed your timeline so it is difficult to know exactly when you filed for ROC but going by your previous post and the fact that you have not yet done your biometrics, I am assuming it was in the last few weeks. If you are going abroad for three weeks soon after your biometrics appointment you will be back well before any decision is made. As Dave said, that is going to take several months.

I heard from lawyer that even though it's deny, I can file apeal. is it an option?

Just wanted to be prepare for worst case senario. What would be my options if they deny my ROC?

I am an IT proffesional so Can I file my H1B?
