My fiance has a K-1 visa that expires January 4. We have arranged for the wedding at the end of December. However, I am told that I am not allowed to bring the signed marriage document to the county office. Instead, I must wait for the judge to mail it. The certificate will take weeks to arrive. I do not think that I will have the official marriage certificate until after the expiration date of the K-1 visa. What should I do about this?

arrowhead,

Submit the I-485 after you receive the registered, certified, marriage certificate.

As long as you are married before your k1 expiration you should have no problem with waiting for your marriage certificates to arrive before filing AOS. you do not have to file your AOS before the 90 days is up.

I 130 & I129F (K3) and AOS info in timeline
