ranting33va.gif These people who are supposedly buying our house are driving me nuts! We had an accepted offer a month and half ago from them and they have been delaying things and driving us nuts. They should really know better (all I am going to say about that). They are supposed to have an inspection of something this week (that they had already partly inspected), but their realtor couldn't get in contact with them so she just scheduled it. Because we've renegotiated price so much, we still don't have the 10% down. If they don't do that inspect this week or sign a new contract (with the new price and terms) and come up with the 10%, we are just going to have to put it back on the market.

So you are in contract? But they didn't have the 10% down at the signing?

Also, what's the closing date?nwhat are the rest of the terms?

No, here they give less than that at offer (we were supposed to get it earlier this month, but because we had to renegotiate those terms changed). It is all very confusing mix of verbal and back and forth signed offers. Right now we are loosely under their offer and a verbal agreement. We were due to close in in a week and a half, but we pushed it out another week and a half because they stalled so much with everything else that we didn't have enough time to clean out the house and they wanted to re-inspect something. We would be ill advised to leave the house empty because it has so many rooms and really needs staging.

All we have now is earnest money, which isn't much. They aren't in any violation of the offer if they walk away right now and I'm sure that given their professions they are quite aware of that.

Ok ok....if I'm correct. You don't need an attorney in ct to close a RE transaction, just need one for the title policy....

So you're not "in contract" like you would be in NY.....

That's why attorneys are a necessary evil in RE transactions.

Each side would be liable for specific performance. With set time frames for each step.

Am I correct to say that your buyer doesn't have to get a mortgage? This is a cash deal....(meaning no lenders involved)

In NYC, an offer is generally accompanied by a "good faith" check for a thousand or 2. But this check never gets deposited. If you have a meeting of the minds, then buyer gets an inspection. Then usually they renegotiate the price a bit for various repairs and such. Then the parties go into contract. At that time, the good faith check is returned to the buyer, and a check for 10% of the purchase price is given to the seller atty for escrow.

Usually, the contract will state the closing will be on or about a specific day. Normally 2 to 3 months. During which time, the buyer gets a mortgage, and gets a title search, survey, etc.....a "final inspection" of the premise is done a few days prior to the closing.....

CT's process is a little simpler...

Since you're not in contract. I would continue to show the house.....

Ugghhh, the Dane is taking a remedial essay writing class right now because he scored a few points too low for Comp 101 and it is hell I tell you. Spoken English = great, someone really asked him a few weeks ago if he had a Boston accent, but the written English (and Danish) is terrible.

It is somewhat similar here, except because it is all cash, we don't need to do the official contract and everything until the actual closing. The MLS rules do not allow you list the property as active in our case, so our realtor has listed it as "continue to show", but most people stay away from those and we haven't had barely any showing since we accepted the offer. We'd have to notify them in writing that we are rejecting the revised offer and then we could switch to Active.

We should be under contract right now and I'm pretty pissed we aren't.

We have an attorney and they have one too, but most of the contract stuff is just the form stuff.

Well, I could certainly put together yet another website for the 'Online Marketplace' and shove the sales leads to actual insurance companies, who'd pay 175 per qualified lead, after closing.

Would take about 2 weeks of my time. You wanna handle the sales contracts ?
