The guide here says that an I-129F should be filed after receiving the NOA1 on the I-130. Our lawyer never mentioned anything about that. Should we be doing that and why? From the current processing times we're looking at about 18 months until they process the I-130.

If you want a K3 non-immigrant visa, you can submit the I-129F after receipt of the I-130. At some consulates, the wait time for an interview for a K3 is faster which is why some people do it. In CDJ, it makes a HUGE difference - 4 to 6 months for a K3 appointment vs. 1 year for a CR-1. But it means you have to continue AOS in the US.

Filling and sending the I-129F will start the K-3 visa, if you don't then you will then be working on a CR-1 visa. Lately the CR-1 seems to be just a bit slower than the K-3, and depending on your situation you me just consider waiting the extra few days or weeks, and get the CR-1, it generates a green-card, upon entry into the country, and you wont need to wait the long time for Adjustment of status in the states.

18 months is not an acurate time.

Look at the timelines for CR-1, and for K-3 for Mexico, and compare.

18 months is not an acurate time.

Depends on how long the I-130 takes to be approved. If it takes 6 months - then add time to NVC and to the consulate - it's accurate because it's currently at minimum a 12 month wait for a CR1 appointment in Mexico.

Our receipt date is Oct 2, 2006, so that would be 4 months for an I-129F and 18 1/2 months for the I-130. The recorded message gives these same dates.

Ok well THOSE dates are NOT accurate. That link shows the oldest petition they are currently working on and is pretty much meant to cover their azzes.

Your I-130 should normally take less than 6 months, give or take. If you are in a hurry, you should file the I-129F (assuming you don't mind the need to adjust in the US) because as I mentioned it's a one year wait for a CR1 interview in CDJ once they have received your file. If you don't mind waiting one year for an interview date, the CR1 results in a green card and then you are finished.
