Then, wouldn't the proof of EA be the K-1 visa stamp on passport valid for 90 days?

Like Joe down in the human resources department is gonna know that.....lol

Most ordinary USC employers are going to ask for a greencard or a social security card. It's all most of them have ever heard about. In bigger more savvy companies they might have heard of an EAD.

When one is an immigrant, most employers are going to want to see SOME piece of paper that makes the employee 'legally employable'. So, even if they know the K1 stamp authorizes employement, they'll still probably look for a SS card. K1 beneficiaries don't have one of those right away and when they do get it, it's emblazened with a statement which seems to indicate more is required.

Oh come on, rebeccajo :) Of course they know all about visas and EAD's. At least in Silicon Valley, where I am, HR people know all about who's authorized to work and who isn't.

Oh but that's not the case everywhere! Not all HR departments are "in the know" about legal immigration and work authorizations. Silicon Valley is a far cry from rural areas.

I work for a very large US Bank and when I was hired HR still had to check what documents they needed me to bring so I could complete the I-9..... I live and work in metro Boston so I think there must be 1000's of employers out there that don't know what documents prove you are able to work... Most Americans still belive that if you marry an american you automaticaly become a citizen........

Exactly! I had the same reaction from my fellow teachers. Here in rural Georgia, it's like that too. Most of the people (employers) have NO idea what to do with a legal immigrant who applies for a job other than 1) ignore his application or 2) send the obligatory "we have nothing we can offer you" form letter. Several teachers were (and still are) astounded that a Canadian and an American can't "just" get married...this immigration process has opened their eyes.

UPS on the other hand didn't bat an eye when hiring my Joel. They sent him the I-9 and W-4's to fill out via email. Thank you UPS!!!!

Jenn,

Darcy came through Detroit also. We did however ask for Employment Authorization. They put a rubber stamp on the bottom of the I-94 that says "Employment Authorized". His SS card says the same.

He will be done work on December 28th. As we thought, the company he is working for won't allow him to work after that point in time. He is on mandatory holiday until we get his EAD card.

February 5, 2007 - Received Welcome Letter

I need to expand and clarify my post.

A K1 visa is adequate evidence of EA for SSA purposes, to issue a SS card. But by the law requiring employers to verify the employability of their imployees, as implemented with I-9, a K1 visa is not acceptable evidence of EA for employment purposes. I-9 lists specific documents that are acceptable as verification of EA and a K1 visa is not on the list.
