1-130 for Indian spouse with no surname

Hi there, I have tried to ask this elsewhere but not gotten any feedback.

We are applying via DCF in Seoul for my husband's visa since I work here, but my husband is from India. He has no legal surname, even though he uses a surname (Khan) in his name and on many documents. However this is not his legal "family name" and surname is blank on his passport.

I worry about applying for his CR-1 visa with no surname because I expect it would be difficult in the future for him to get any kind of documents in the future (bank account, license, SSN, etc) without a last name.

Has anyone else run into this problem? I would like to just file using his last name, making a note on our cover letter that his passport lists no surname but he has a last name on other documents (marriage certificate, bank account, other visas, etc) ... would that work? I'm just paranoid about getting everything done and then running into trouble later...

9/6/2013 -Priority Date 5/13 /2014- Case number and IIN assigned

2/25/2014 -Transferred to NSC 5/20/2014- DS-261 completed

3/31/2014 -Approved 5/21/2014- AOS fee invoiced and paid

5/22/2014- AOS package overnighted to NVC

5/28/2014- AOS scanned into the system

6/20/2014- IV invoice email (but fee still locked on CEAC )

6/23/2014- IV fee finally unlocked and paid.

IV package overnighted to NVC

6/30/2014- IV scanned in. DS260 completed.

7/1/2014- AOS accepted

7/2/2014- False checklist (AOS reviewed)

8/1/2014 False checklist (attorney's G28 reviewed)

8/2/2014 False checklist (NVC not sure why it was generated)

I am the beneficiary. 8/12/2014 CASE COMPLETE!

8/26/2014 Medical

9/2/2014 Interview... APPROVED!!!

9/5/2014 Visa in hand

Removal Of Conditions:

10/29- Package sent to VSC

11/1 - NOA1

11/17- Received biometrics appointment letter

11/30- Biometrics appointment

its country dependent, i had to change my name on birth cert to match those on my other docs as requested by the usemb here so i did an affidavit and requested for a new bcert.

so iim thinking an option would be for him to get an affidavit for change/append of name, then the name becomes legal ...and yes a new passport with new name so the "khan" can be used everywhere. ....just my opinion

Unfortunately India is a complicated place to do any kind of bureaucratic formalities. It took about 9 months for my husband to even get a passport and several months for us to get a marriage certificate - I shudder to think about going through another process for a legal name change and new passport. wacko.png

Thanks to Blueberry Pancake also, I have read that thread you linked to, and most of the advice is to simply write "None" or "No last name". I guess my main concern would be future difficulties for life in the US.

Couldn't he take your last name?

Actually the majority advice or opinion in the thread BP provided you was to use (- ----- ) in the last name space. See the pushbrk's and others within that thread.
