Thank you everyone, you were so helpful,

There are some of the evidence that i sent to USCIS when I applied to adjust my status that I don't have anymore, she kept them and didn't give them to me, is it possible to call USCIS and request copies of the evidence i submitted to them when i applied for AOS ???

I would think your divorce lawyer should be able to refer you to a immigration attorney, like I said while the divorce complicates your ROC you certainly are not the first person. Again all you really have to prove is your intention was to make the first marriage work. I assume there have been motions filed in the divorce case already. Does your estranged spouse allege in the papers that you married only for a green card? Some of those court filings might help you depending on what they allege.

As for the email from your estranged spouse's father, the problem is that easily can be faked. I think if he is willing to sign an affidavit attesting to his belief you were trying to make the marriage work, that would be great evidence.

As a green card holder, you have the right to reside in the country up until your green card expires. Once you file for ROC, you get a one-year extension. I would not plan on moving to Canada or any other country voluntarily until your ROC is denied. Normally, you are given the opportunity to voluntarily depart but I doubt it will get that far.

Short answer for your question: Yes.

A friend of mine adjust his status after his first wife went "a.w.o.l" just before the firts interview just to "get back at him" (...), anyway he got his temp GC and he filed for a divorced on the grounds of "home abandonment", he got his divorced an went on with his life, a year later he found the love of his life and married her, she file a petition for him and they went to the whole process again at the end he was approved.

Thank you for your answer, did he have to leave the country and apply for a visa again? do you know how long he and his ex wife lived together before they got divorced ?

Did you "friend" enter on a K1? A K1 situation is unique.

Does it matter ?

No it doesn't. Separation isn't a grounds for cancelling AOS, or filing ROC.

Just apply using whatever you can. If you're denied you'll have to go the CR-1 route.

If you can get some kind of statement fromyour ex's family,it will go a long way in helping you...As long as the statement makes it clear that you entered the marriage in good faith.I have always been friends with my ex's daughter and still friends till today and was able to get her to narate what happened btw me and her mom on fb so that gets added to your pile of evidence stating your intentions and that helps a lottttt.actually much more than most other evidences you might get
