I filed an application for wife and my 3 years old son in Haiti years, I wasn't an American citizen at that time, the I-130 was approved, I became an American citizen in May of that year and decide to upgrade the case. I surprised to learn that I have to filed a separate I-130 for my 3 years old son, which means my wife will come before him. Don't

want to leave him in Haiti, I decided to apply for a K3 in order for to come with his mom. Did I do the right thing? Please let me know.

k3 are rarely granted. File the I-130 for your son, delay at the NVC until his file can be met up with hers.


Also include a copy of the NOA1 (and/or NOA2) of your wife's file so the USCIS can meet up the two files if possible.

yesterday I just filed a K-3 after my lawyer called and suggested it. I am an April filer for the I-130. ( already 6 months in) I was told they will re-start processing the k-3's. Processing time is posted at 5 months.

My K-3 is being sent to the TSC. With the estimated 16 month processing time for the I-130's, he said it makes sense to file the K-3 and see what happens.

The reason the K-3's were rarely granted is because for a while there, they were getting processed at the same time with the I-130's. Then the K-3 got cancelled.

With the huge delay at the NBC, hopefully the K-3 processing will pick up . It looks like they will get processed way before the I-130s.

The K3 have never been cancelled.

The NVC made an administrative decision, based on a USCIS decision, that if they receive the I-129F at the same time or after the I-130, they would administratively close the I-129F. Really they're making less work for themselves because they're not processing a bunch of different visas, but at the same time they're making more money for their department of the government (which is not the same as the USCIS's department of the gov't.)

The K3 was always on the books, but rarely granted due to the simple factor of when the I-129F vs when the I-130 reaches the NVC.

It's still possible for the I-129F to make it's way to the NBC to be processed alongside the I-130 but you're right that right now, it looks like that may not be happening. Pursuing the K3 at this stage is entirely up to the couple.

It seems you have to file a I-130 for your son, that's the way the policy is written. when you filed the petition for your wife, you shoud have also filed one for your child separetely. That is what I understand as far as the I-130.

For example, I filed an I-130 for my spouse and filed a I-129f for a K3/k4 for her and her child (mystep child), I am an American citizen, but if my I-130 is approved prior to her being issued a k3 and k4 for the child respectively, the child will not be able to travel with her because I did not file an I-130 petiotion for the child as well. The reason is because now, the spouse is coming as a permanent resident and not on a temporary visa. Now that I noticed the I-130 petition might be approved before the k3/k4 visa, I am filing an I-130 petition in the coming week. My spouse and I, planned to have her stay in Haiti and finish out the school year anyways, but atleast now we know the I-130 will be approved by the time the school year ends in June.

I filed the 1-130 on May 8th. And so far only received NOA1.. I'm seriously considering filing the K3 Visa now. I don't have anything to lose from doing it now I suppose. Good Luck to other filers
