Hello everyone! The type of visa we are processing is CR1, I am aware that shortly after arriving in the US, CR1 visa holders are then mailed their green cards within a month or so and are allowed to travel outside the country. If all goes well with my interview, I will be flying out sometime this November but intend to stay in the USA for roughly just a month. I will be coming back here to the Philippines to take care of other things while my husband flies out to finish his contract abroad as well. We intend to go back to the US at the same time around May or June of next year. Will I have problems getting back to the USA after roughly 6 months of being out of the country? and flying out just a month after I entered the USA? Thanks

When you enter the US on the CR-1 visa, they will stamp your passport which will act like an I-551 which is the document number for the GC. So you will have a GC and can turn around and leave the very next day or later that day if you so choose. The second part depends on the CBP person you encounter when you try to re-enter the US. If you leave for more than 6 months, you MAY have problems as it may look like you are only visiting the US and not living here as a lawful permanent resident (LPR). You may want to take evidence to show you have ties to the US and not your home country or you could return to the US before the 180 day mark. You may not have any problems at all or you may spend several hours at you POE trying to convince the CBP that you are not using your GC like a tourist visa.

Good luck,

Dave

Ok...it's not my personal experience with this, but last year, when coming back from the Phils, the woman in front of me upon landing in Chicago was getting a real hard time from the CBP. She had a valid green card, but had been away for a long time apparently. The immigration dude was telling her he could cancel everything and send her back. Poor girl. She eventually got let through, but only after several minutes being brow beaten.

Just something I saw.
