Section 203(g) of the Immigration and Nationality Act requires that your registration be canceled and any petition approved on your behalf canceled, if you do not apply for your immigrant visa within one year of being advised to do so.

You were advised of this requirement over 1 year ago, but we have not received a response from you since then. As a result, your application for a visa has been canceled and any petition approved on your behalf has also been canceled.

Your application may be reinstated and any petition revalidated if, within one year, you can establish that your failure to pursue your immigrant visa application was due to circumstances beyond your control. Please provide a written statement to the Embassy or Consulate outlining the circumstances beyond your control and noting that you still wish to pursue this visa petition.

Please I need help what to do next,

Initially on 25th september 2012 I have recieved 221g white slip and 3 months back I have submitted few documents and again I got another 221(g) white slip asking for PCC,medical and i-864,which I am going to send them in few days, however on the white 221g slip which I have recieved says one year so please help me understand this.

Thank you so much

this is key for you:

So do you have an explanation for them that was out of your control why it took you so long. And now you submitted the papers and got another 221g. Goodness.

You need to notifiy your embassy and get some direction what to do.

Yes ,It was delayed only due to I-864 which I coudn't get a joint sponser, however my wifes income now is $42000 per year and I also found a joint sponser.

I have a question ,the recent 221g which I have revieved few months back also said that I have to complete within one year ,so I thought from that date to one year.

Will that be okay to send the required documents with a written explanation why it took so long in a few days?

Thank you so much for the reply .

well this letter you posted when did that come? before you sent in this new evidence? I would say you need to get your medical and I-864 in right now. They have been waiting a long time and you sure don't want that petition to get closed or sent back to USCIS.

Do you have everything ready? Too bad you didn't have it already but do it now.

I did not receive any mails from the consulate, when I checked the status online it says that.

They game me a 221g white slip 3 months back asking for PCC ,medical ,I-864 and my passport, which I am going to send them in few days as soon as i get the mail from my wife.

mean while when I check the status it shows that status.

i claim it's a data error. As long as yer within the timeline given by the IV Unit to send in new documents (this is usually a year) then you are OK.

You could have your USCitizen spouse call the DoS Hotline and inquire - DoS's computer system (shared with the IV Units worldwide) is more accurate than CEAC online web portal status checking thingie.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !
