My other half just spoke to the most unhelpful tier 2 and was told that it takes 12 months for i-130's, eventhough the website says 5months. According to this officer the numbers on the website means nothing as they aren't accurate and that I(we) should be prepared to wait another 7months.

She also stated that if you do a service request you DELAY your application because your appication gets pulled and then it has to go back in the "pile".

She also stated that they do not process in order because of "internal" reasons. However, she would not clarify what these internal reasons are.

So, I went from being excited that I would be approved soon'ish, to being rather unhappy.

I truly wish that these people get to experience what we have to go through. Maybe then they would treat us slightly better.

Dr.W

that makes no sense. People on the August forum have posted that they did service requests and got approved before the DR became due in 15 days. They will tell us anything.

i agree with this. they can't on the one hand tell you to file a service request if you're over the date, and then slow down your case when you do so. and you're right about all the August filers.

i've also run into a Tier 2 rep. who didn't know what he was talking about. in OPs's case, they shouldn't have told the person to be prepared to wait another 7 months. the rep. obviously has no idea how much that can hurt a family. and OP is right: if the reps had to go through this process themselves things would be quite different in the way applications are processed and the way we're treated as "customers"

This is strange. I know that attorneys use the published data to get writ's of mandamus. They show up in court with the published data and the judge forces USCIS to honor it. I'm wondering if this is a new benefit USCIS is extending to fellow attorneys so that they can make more money.

I believe they are processing things out of order to shut up half of the people. Given that it is election year if everyone is angry, it doesn't help the incumbents. However if half of the people are unhappy, things look a little better for the incumbents. By sending a few adjudicators on a blitzkrieg raises the hopes of everyone who filed in the months after.

Hopefully you will have some swift action. My application is with Vermont too and you are the first case from that center that I have seen since I joined here, my case went directly

to Vermont because it was after October 22 priority date Oct 23..we havent gotten approval yet, so I hope we get word soon. Good luck with this it shouldnt be much longer now :-)

Thanks. VSC is processing NBC transferred cases from early October. I am pretty sure you will hear something back in a week or two. If you don't hear back in couple weeks, you can request to file service request by calling them. In any case most of the wait is over. Keep us updated here.

My other half just called again, and this time, the tier 2 was quite pleasant. She suggested for us to do an expedite which she then typed up and submitted for us. Apparently we should have an answer in 5 business days.

I didn't think I met any of the expedite criteria which is confusing as she suggested it, and then formulated the request.

You sure she filed expedite request? She probably just filed service request since you're out of official processing times. Expedite request needs proof of expedite and almost a month to get approved/rejected for it. Service request on other hand can be filed on phone and takes few business days to get response just like you said.

She filed a service request, and gave us a reference number for it. Then she filed an expedite and gave us a reference for it.

So yes, I'm 100% sure she filed an expedite.

She's just scaring you into not doing it because it means extra work for them. They are probably completely swamped and doing whatever they can, including lying, to get people off their backs. If they managed themselves better, they wouldn't be in this mess to begin with. No way does an I-130 take 12 months except in rare circumstances - you can see for yourself that April 2013 filers are petering off now.

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

If you sign up for the text/email notifications on the website then you don't have to keep refreshing the status. Literally as soon as it's updated, they ping a text/email to you.

It's funny because I've signed up for the text/email notifications, but I still check the USCIS web site thinking, "Maybe they approved my case, but there is a delay receiving a text/email?" NOT!

I promised myself not to check it more than 3 times a day because it honestly does more harm than good. Every time I check it, I keep getting disappointed and keep drinking more (more $$$ for beer and wine)! Boy, this immigration process is getting more expensive!

Was that just from the G-1145? They'll only tell you they received your application with that. You need to make an account on the USCIS site and tie your case number up with it to get any further updates. If you've done all that, then I don't know why it's not working for you :S
