Hi everyone,

Still waiting for an approval from NSC. :( Congratulations to everyone on their approvals thus far! Really happy for you all! Let's hope the rest of see something this week. Question, maybe some of you guys can help us out. Since I don't think the approval process is going to speed up any time soon, I don't think my husband will be home anywhere near the end of May/early June. My best friends wedding is in Acalpulco, Mexico on May 24th, my cousins wedding on May 25th in LA, and my cousins engagement party on June 7th in LA. I know my husband can get into Mexico but flying from AUS to Mexico is about 6k instead of $1600 to fly through LAX. Any experience with getting a transit visa? Do you think he would be approved for one? Should we wait till his I-130 is approved before applying? If we waited till I-130 is approved, do you think he would be successful in applying for a tourist visa just to come to the weddings and engagement? Just want to make sure nothing is going to affect his application for his actual I-130, but I would really like for him to attend as these are important events for me an my family.

Any thoughts or opinions you guys have will help.

I just got the approval email (NOA2) from NSC after waiting for 6 months 1 week and 3 days! :thumbs:

It took longer than I had expected, but it's better than never! :)

I hope this week is going to be a great week for us! Come on NSC, TSC, and VSC! Drink lots of coffee and work harder! :dance:

I am going to visit my husband in LA from this weekend:)

So I called USCIS today and I did file a service request. I talked to the first person on the phone (tier 1) and the representative did it for me. She just asked me the normal info/ questions and confirmed that I was in fact out of processing time (my priority date is 10/1). There was no mention of waiting 60 days after the transfer or anything. She did it and gave me a reference number

I have no idea if the service request will make any difference, but hey, I tried. Can't hurt. Seems it did work for some people in the September group.

No, they stayed as MSC :)

ROC from CR-1 visa (Green Card expiration date was Nov 24th 2016)

 

Link to the evidence I submitted. Be sure to send evidence spanning your entire marriage (especially for K-1) or as far back as you can. Just one or two bank statements will not cut it. I primarily focused on the two years of living here since I came in on a CR-1. If you don't have the fundamentals (i.e. joint accounts/policies), you can explain why in the covering letter. E.g. "While we do not have joint utilities, we both contribute to them from our joint bank account".

 

September 26th 2016: I-751 package sent to CSC

September 28th 2016: Package delivered
September 30th 2016: Check cashed
October 3rd 2016: NOA1 received with receipt date of 09/28/16
November 3rd 2016: Biometrics received with appointment date of 11/14/16.
November 14th 2016: Attended biometrics appointment
October 30th 2017: Infopass appointment to get I-551 stamp
February 26th 2018: I-751 case number (aka the NOA1 receipt number) becomes trackable
March 14th 2018: Submitted service request due to being outside of processing time.

March 15th 2018: ROC approved. 535 days (1 year, 5 months and 17 days)

March 29th 2018: Card being produced

April 4th 2018: Card mailed out

April 6th 2018: Card in hand. Has incorrect "resident since" date. Submitted service request on I-751 case (typographical error on permanent resident card) and an I-90 online.

April 2018 - August 7th 2018: Tons of service requests, emails and now senator involvement to get my corrected green card back because what the heck, USCIS. Also some time in May I sent a letter to Potomac telling them I want to withdraw my I-90 since CSC were handling it.

August 8th 2018: Card in production thanks to the direct involvement of Senator Sherrod Brown's team

August 13th 2018: Card mailed

August 15th 2018: Card in hand with correct date. :joy:

October 31st 2018: Potomac sends out a notice stating they have closed out my I-90 per my request. Yay for no duplicate card drama.

Boy, there are so many messages on the thread! Reading messages on the NVC thread is like almost having a part-time job! :bonk:

Haha I knoow! But I just can't resist to read everything so I find myself checking VJ everytime I get a chance... My husband says I'm a bit obsessed lol.. But I want to make sure the process runs smoothly and avoid checklists :/

I've managed to skim over some posts... Some people ask simple things that are already on the wiki over and over again and others ask regional specific stuff about their required docs- especially police certificates and birth certificates. I can't help much on that part since I'm the only Venezuelan on VJ who is currently at this stage besides the user Leebea.

Oh well, congrats again to you and the other recent approvals!!

Hopefully this week we'll hear of more approvals :)

Hmm your situation is tough :(. I know it sucks, but I would say that it would be better for your husband to go direcly to Mexico. The thing is that even if he succeded in getting a transit or tourist visa, there's always the possibility that the customs officer in the US denies his entry, since your husband is currently applying for an immigrant visa and (to the eyes of the officer) he might want to stay in the US.

I'm sure that he would never actually do that, but the officer might think otherwise. And if the officer denies his entry, then he would have to buy another return ticket and in the end spend more money. (tickets to US+ tourist transit visa fees + new ticket to Mexico if he still decides to go)

Some people have succeded in doing this and others haven't, but the risk is always there. The fact that the I-130 is approved or not does not change anything, because he is still on the immigrant visa process, regardlesss of the stage he is at.

I agree- things are toooo slow with the VSC. I just filed a service request today because I am getting a bit frustrated (my PD is 10/1). You could always give it a try. I did it because I figured it couldn't hurt. I hope this week VSC filers will have better luck!

Tourist visa wont influence on spouse visa processing, I made all application forms and everything just changed plan and didn't pay fee! I clarified everything and it is ok but read about it online. If your USC spouse lives in USA and you trying to visit her you have little chance to get if you live together overseas you have much more. Also you have good evidence you wont stay, bc why must you hurt yourself when you can get Lawful immigrant soon.
