I am totally confused by skis instruction about following to join benefits.

My wife became permanent resident; she would like to bring her UN married 16 year old son from Colombia. She came on a fiancé visa.

Instructions say, your children may be eligible for following- to- join benefits if:

  • You Immigrated on the basis of a fiancé petition

Also for your child to be eligible for following- to- join benefits, he or she must:

  • Be under 21 years of age and
  • Have been a child from a marriage of yours (the marriage must have existed at the time of your admission to the U.S.

If she came on a fiancé visa, how can she be married at the time of admission to the U.S.?

Am I interpreting this the wrong way? Thanks for any help with this question.

Your can't bring a child if it isn't a product of a marriage that took place prior to coming

I am not actually sure how you would have a child by a marriage other than the K1 created one and have that before the year after immigration ( but I am sure someone has tried it or they wouldn't specifically prohibit it . ) It may come into play under K3 /K4

This will not be over quickly. You will not enjoy this.

I belive that you and her could do the requierd documents for petition. The only negative part for you will be paying and going to the process the second time ." Am I interpreting this the wrong way?" Yes you are it happens to all including myself . Start Document recopilation , forms + fees . Remember the Father of the child in question must grant your wife in writting the exit of the minor from Colombia . This must be notarize in Colombia also . If the person is dead or MIA your wife must go to country and request full custody of the Minor . One this is all done the kid will get his visa and will be able to Pigi back the rest of the way base on the Mother legal US situation . My situation was slightly different as I marry in Colombia and my wife also had a Kid from a previus relationship . My steph kid pigiback the process w. her MOM . Good Luck
