Just 10 years after the Supreme Court upheld the University of Michigan’s use of race in admissions as a necessary step to foster campus diversity, the justices are set to decide whether that state’s voters are allowed to ban affirmative action in admissions entirely.

The case, Schuette v Coalition to Defend Affirmative Action, is one of several controversial cases on the docket in the 2013-14 term, which begins Monday.

If the justices decide in Michigan voters’ favor, it could lead to a spate of states banning affirmative action through ballot initiatives and would almost certainly result in declining enrollments of minority students in public colleges around the country.

In 2006, Michigan voters approved a measure to amend the state constitution to prohibit the government from “discriminat[ing] against, or grant[ing] preferential treatment to, any individual or group on the basis of race, sex, color, ethnicity, or national origin in the operation of public employment, public education, or public contracting.” The voter initiative, called the Michigan Civil Rights Initiative, effectively banned affirmative action at state schools.

The measure came just three years after the 2003 Grutter v Bollinger case, where the court decided in a 5-4 vote that the University of Michigan Law School could grant admissions preferences to minority applicants in the interest of fostering diversity for the entire study body. (The decision barred the use of racial admissions quotas, however.)

Black enrollment has plummeted 30 percent at Michigan’s undergraduate and law schools since the 2006 affirmative action ballot initiative. Nine other states have barred the use of race in admissions as well, and the Supreme Court’s decision this year could either cement those policies or effectively eliminate them, depending on its scope.

Funny thing about Affirmative Action, they never focus on the group that benefits most from this. White females. I wish they would get rid of it, but as long as racism and sexism exist, it will continue.

The way this court has been voting I see it being sent to the states and then all the red states will be on their way to quasi separate but quasi equal agenda.

Oh yes, especially if it effects any Caucasian's then it needs an immediate remedy.

Even if the remedy removes a previous remedy to correct hundreds of years of racism.

The argument is a thing of beauty. If he was alive Martin Luther King would say "what the **** are they saying now?"

You can never correct what was done to that generation. That's what they can't understand. The only thing they should do is get rid of AA and hire off merit and common sense.

I agree with the position, but it's the claim of some that they are unfairly treated because of it I take issue with. Racism is alive and well...make no mistake about that.

I agree with the position, but it's the claim of some that they are unfairly treated because of it I take issue with. Racism is alive and well...make no mistake about that.

Oh, I know this all too well. When I converted back in 2011, the iman asked me if I was ready to shoulder the burder of being a muslim. I looked him right in the eyes and said, I'm a black man living in America, it can't be worse than what we already go through.

My beef is folks that complain about AA, and then go on and say they wouldn't hire a black person because of some racist notion in their heads.

I remember during Katrina they showed white people coming out of the stores with items in their hands and they were considered "foraging for food" and all the blacks were "looting" stores.

I remember during Katrina they showed white people coming out of the stores with items in their hands and they were considered "foraging for food" and all the blacks were "looting" stores.

Sure there was looting to some degree, but even in the simplest reporting there is a biased to see blanks and whites differently. Yet people don't see that that there is bias in their thinking intentional or not.

It's deeply ingrained into our culture here and abroad. White people are considered the pinnacle of the human race. It's what other races strive to be. American Black people are considered the worst. This is why you'll never hear white on white crime.
