This is what I'm trying to understand: what credible evidence normally exists to bother the USCIS with? How do you prove premeditated duplicity?

Very sad situation I would gather all the evidence and turn her in. We go through so much in the process of getting our love one's here to get kicked :( sorry for your situation... best of luck to you

Well for some if lucky the one being bad left a paper trail. I have known some who tapped into their love ones emails and chats and not just found cheating but plotting. Scamming how it all was being staged to "Get" the USC.

So it does happen. Now many unfortunately just have words and threats and its hard to tell USCIS she /he did this and that and have nothing.

That's my hunch too: it actually clogs the system more if OP embarks on phone/write USCIS campaign without hard evidence. And 90% cases depicted as fraud do not have it

I think you should file for a divorce, call uscis and make sure they send her back to her country. collect facebook pic, text messages, emails, witness.

Yes, you should! NO ONE should be abused in this manner.

yup, sounds like a scam.

You'll need to generate hard evidence of it,

and get into a local USCIS office via an infopass appointment

and

then ask to talk wtih the FDNS officer.

Docmentation is very important.

Still, it's on the FDNS officer to investigate, so expect some time on this.

FDNS did not work for me whatsoever. Lazy, apathetic gov't workers IMO. Not happy with this part of reporting fraud.

for marriage fraud, is best to engage with a FDNS officer at the local USCIS office. Face to face, the first meeting.

Am I getting correct impression: people confuse proving adultery with proving a scam? ancient wisdom says: you can't scam an honest person!! In well publicized Ponzi fraud by Bernard Madoff, thousands of wealthy investors lost fortunes to his scam. Once investigation started, many of them didn't come forward. Why? Because going in with Madoff, they were seeking an unfair market advantage to begin with...Ask yourselves: what were you looking for during your original USCIS petition? Emotions aside, how did you get yourself in this mess? Why (other than canceling sponsorship) are you going to USCIS again, now trying to prove the opposite of what you tried to prove so hard before? There is one more trap USC falls into: the spouse who now tries to get away, tells USC that it was not a true marriage all along (just for the clinging USC to let go). Armed with such confession, USC aggressively appeals to USCIS...But it's all wishy-washy, it's all relationship games and have nothing to do with premeditated fraud. Am I correct that proving premeditated fraud is very very rare?

I had and did turn in lots and lots of evidence, but my ex filed I-360.

This woman likely has a conditional green card.

Maybe evidence will block her permanent card, but it will take YEARS AND YEARS. USCIS is so SLOWWWWWWWWWWWW.

Isn't it ICE that deals with this not USICIS?

Naw ICE could give a rip. Unless it was a terroist crack ####### violating their immigration priveleges. Then they might take a look see. This is more a domestic, "he said she said" for USCIS and like Darnell said a sit down with a real person at USCIS.

I wouldn't have married if USCIS had this warning in place!!!

Funny how the Philippines have those CFO seminars tthey have to go to to leave the country. You would think the USA would have same since thats where everyone wants to immigrate to.

Lets see you would go to local office and they pull up their horror show for the country you are petitioning from.

I know I could add some good scare tactics in their that would make many women at least from US run the other way. LOL Just say. ;)

Verysadguy, you had enough evidence to win custody... 90% of Broken-hearted USCs have no children and no hard evidence. And they lack lucid disposition to understand that they can't go back to the same government strangers they initially begged for acceptance, with the opposite story now. This strains the agency even more IMHO than their initial ill-conceived marriage journey
