I need some help with a waivber request....

Hi,

I apologize for not researching the forums on this.... I am at work now and I dont have a lot of time before the boss comes back......

I did a K1 visa with a woman from Ukraine a little over a year ago i think. Everything went through smooth as silk and she got approved and i bought the plane tickets and sent them to her. The thing is, we broke up before she could fly over here and that was the end of that so to speak.

Fast forward to present day....I meet a woman in Bogota, Colombia in July 2006 and we decide to do a K1 (FYI...neither of us married before, no kids, convictions,etc). Anyways, I get home on Monday night from Bogota (the second time I had been to see her since July) and I have this form telling me that they are going to deny our K1 if I dont submit a waiver request.

I understand why they are sending me the form, they attached a sheet that explains it very clearly.

What I need to know is what they are looking for....

They mention something about writing a letter. Thats no problem, I will be happy to write a very detailed letter explaining the situation. The part I am confused about is the "evidence". They mention things like death certificates,etc. The thing is, I am not sure what "evidence" there is to enclose....like i said before, what happened was that we were together throughout the whole process until the end and then we broke up before she was to fly over to the US. As far as evidence goes, the only things I can think to enclose with the letter are the refund (shown on my bank statement) that I got on the tickets to fly the ukrainian girl here from ukraine and the pictures, receipts,etc that i have from my past two trips to see my fiance in Bogota (the two trips i have made since we got engaged). i have stayed at her house so all these pictures are of me and her with her family and friends,etc.

if anyone can give me some links to threads about what should be submitted as "evidence" i would really appreciate it.

Also, any advice that could be offered as to how i should go about this would really be appreciated also. Thanks:)

p.s. sorry about my spelling of "waibver" in the topic headline,LOL.

There are several good descriptions of waiver requests submitted by VJer's and listed in this forum. Take some time tonight and review the details. You will need to look into several to find the descriptions they have provided.

If you can't find them, then PM me and I'll send you some directly. But the research will be good for you so that you can prepare the waiver with details and documentary evidence. It seems kind of crazy but the USCIS is being very harsh with demanding the waivers. It seems that in your case the waiver is required because the last approval was within two years.

So, take your time in constructing your waiver request. Make sure you have all your facts correct and the time line accurate. Be prepared to state your case logically, factually without any complaints about the system or the IMBRA law. That won't help your case.
