Hi there,

So, my fiance entered the US through SeaTac Airport and he says that the people at immigration took his papers - (his criminal record, health check, birth certificate, etc.) Now we need these papers to apply for a Green Card. But I don't know if we need to request them all again or not. We've started trying to get new copies but it's difficult because he's in America now and cannot go get them himself. Has anyone else had a similar experience? Does the immigration office have his papers stored away somewhere? If anyone with experience could give me some guidance it would be really greatly appreciated.

November 15th, 2013 - Biometrics Appointment

Hi there,

They were suppose to take the medical information, but not the BC. Does he have a copy of the BC. Any copy will do and then have a translation done. The medical for a K-1 is to verify that the vaccinations are complete so another I-693 is not needed. Just the part about the vaccinations. When completing the AOS you enter the A# and they should be able to get his BC that way or they will issue an RFE for another copy of his BC. You might include a copy of the bio page of his passport to show date and place of birth. Please take a look at the guides for more assistance. It is not like they do not have a copy of his BC as it was submitted to obtain the K-1 visa. I would recommend he some how get a few extra copies of his BC for later use.

These docs were collected at the POE and will follow the case to the AOS meeting. See the guides for the info you may need about doing the AOS.

Just FYI... we came through San Francisco and the USCIS officer took the entire packet. He did not return any papers to us. The officer thumbed through the packet about 10 times then stamped her passport, welcomed her to the US and sent us on our way.

Your fiancé doesn't anything that was in a sealed envelope - that will be forwarded to USCIS but he will need certified copy birth certificate again (and a translation if not in english) for AOS.

What usually happens people bring original certified copy and a photocopy of it to the interview, CO keeps the photocopy after viewing the original that we get to keep and take with us to US.

For future reference, I would advice to bring extra copies of the BC and family relative certificate. I know in our case, while it's not necessarily hard to get those documents in Korea, you do need to be in Korea. My wife and I made copy after copy of her police record, vaccines, birth and family certificate, etc. She has family in Korea, but who knows if they are allowed to access those from the district offices or not. Anyway, hope things work out!
