How can I employ my brother who lives abroad?!

Hello all,

I currently own a small business restaurant, at this point I cant find myself the time to run my business.I have tried hiring managers and promoting team members. However, shortly after that i am taking back over my business due profitless business management.

I would like to bring my brother to take over my business, Where do I go from here?

He is 25 years old, and he has a gastronomy degree.

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

A H1-B visa or an employment based green card come to my mind when reading your issue. However these things don't go fast and easy, and can take several years to complete (plus several $K). Maybe someone else can assess your situation better.

First, you will need to hire a lawyer.

Second, you will need to prove that you could not find a qualified US resident who can do the job and that is why you need a foreign worker. You will need a Dept. of Labor certification.

Third, you will need to apply for a non-immigrant work visa for your brother.

Keep in mind that the US likes US jobs to go to US residents. No reason to allow a business to bring in a foreign worker when there is a qualified US resident who can do the job. You will need to prove that no US resident is available to work for you as a restaurant manager and that is why you need a foreign worker.
