I met my husband in person 2009,he proposed to me 2010 and i traveled down to his country Nigeria December 2010 and i spend the whole of 2011 with him just to know him more and finally we got married December 15th 2011 and left to US 2012 January.i filled for him April 2012 and all the process took 8 months and finally they fixed his appointment date which was March 14th this year.i came all the way from us to accompany him to the interview but i made a little mistake.on getting to the entrance i was told to wait out side so i took all the evidence back from my husband file and i told him to go inside and forget about the other evidence because already i submitted all what they ask from me.sad news my husband was denied visa because the consular says that our marriage is not bonafide,i felt so bad.i went back to my country hoping they will send it immediately but it took them three months and some days after i contacted congressmen. Now they emailed me and this is what is on it,

Your Case Status: Post Decision Activity

On October 1, 2013, we mailed you a notice indicating we intend to revoke the decision made on your case. That notice will explain in detail what action we intend to take. Please read it carefully when you receive it. If you have not received the notice within 14 days of the date above, please call customer service at 1-800-375-5283 for further assistance. If you move, please use our Change of Address online tool to update your case with your new address.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revoc

can any one tell me what this mean and what i should be expecting on the letter because i have not gotten it yet.

It's a Notice of Intent to Revoke. USCIS have agreed with the consular officer's assessment that your marriage is not bona fide, and have provisionally decided to revoke their prior approval of your I-130. You should expect to receive that notice within the next week or two.

You will have one final opportunity to change USCIS' mind and convince them that your marriage is legitimate. You will need to submit absolutely everything that you can think of (whether previously submitted or not) that attests to the bona fides of your marriage. I believe you will only have 30 days from the date of denial to do so, so time is not on your side.

You may want to consult with an experienced immigration attorney, because you are essentially a hair's breadth away from rejection, and Nigeria is perhaps the most difficult embassy in the world to go through.

When you receive the NOIR, the notice will specifically state the reasons why it was sent. When you prepare your rebuttal, you must address each of the reasons with evidence. Additionally, your rebuttal must be submitted by the deadline on the notice (which as Hypnos already said, is likely to be 30 days). Failure to properly respond to an NOIR will result in the original approval being revoked. Additionally, a proper response to an NOIR does not guarantee reaffirmation and reaffirmation does not guarantee a visa will ultimately be issued.

do i really need to appoint an immigration attorney to help with the case @hypnos

I would say its wise to consult one. You have done what few have spent a year with your husband. So either you didn't front load your petition with good compelling evidence or they investigated and found something.

You will know why soon when you get your letter.

I'm with Hypnos. A professional might be able to help you out here more then doing it yourself. You seem so close, It would be really bad if all goes downhill just because of minor error.

It's amazing how many questions can be resolved with a 2 minute Google search...

Sorry to hear that! Stay strong and be ready to rebuttal their decisions like others have already mentioned. That's so crazy they would deny you guys, after you have done with most people should do and spend significant time with the person you want to marry. You did show them proof that you lived with your hubby for a year right?

Madam, you have went above and beyond what seems to be personal prudent proof of a bona fide realtionship. One year in Nigeria?

Something must have awfully went wrong with the petition package and interview for USCIS to want to revoke thus you might want to contact an Attorney. I know cost is a factor.

Your city name in your profile made me crack up and I had to look it up, I found Deerfield Beach not Deefiled Beach.

You have a lot of work to do so please be diligent.

Either you sent a very thin package or they found something serious in your spouses history. Start by arranging the evidence you have imagining things they may say about your relationship . When you get the actually letter rearrange what you started based on their actual points. You must refute every point, If you are going with legal help remember sometimes the very best are cheaper than the average one and they get their reputation for a reason.

This will not be over quickly. You will not enjoy this.

Also another thing that jumped out at me.Now think like a CO. Although you iving in said country is fne. You lived there a year than married left and filed. Maybe they think you married for imigration purposes and weren't sure.

Is ther red flag?

1. Age difference

2. Divorce

3. children

4. Previous K1 or CR1/IR1 filings

5. Multiple marriages

6. Religion

What evidence did you submit with your I-130? With a year you should have had a good co-mingling of finances. Pictures and good evidence with you and family and friends (CO's in Lagos love that).

Really sorry but just get your letter come back and maybe we can help guide you. You won't have much time. I know someone who got NOIR and they had 2 weeks. So be ready start gathering evidence now. Just in case (you remember all that pringing from before) and you have all the evidence you didn't give him at interview.

Well god luck God bless.

if you don't mind could you share with us the types of questions they were asking your husband and what his answers were. Hope you guys went over it when he got back to you, in case there was a question he didn't know how to answer that might of messed things up. If not tell him to write down everything while its still fresh in his memory. Does he suspect there is a particular reason why the CO said no? This seems like such an outrageous denial... clearly their has to be something missing

My husband and I just got approved for his visa. We received a Notice of Intent to Revoke and we were reaffirmed. I know that it is heartbreaking, but take it one day at time. Answer the Notice of Intent to Revoke. Wait for the Reaffirmation. Wait for the new interview. Prepare for the worst and hope for best as we did and your husband will get his visa. I am so sad you have to go through this, but God is good and if you do not give up, your husband will get his visa.

You may want to consult with an experienced immigration attorney, because you are essentially a hair's breadth away from rejection, and Nigeria is perhaps the most difficult embassy in the world to go through.

What a heartbreaking decision. It must be an emotional rollercoaster. I do agree with Hypnos. You need all the help you can get with an experienced immigration attorney that has done many Nigerian cases like yours. If you do get a rejection, you will have to file again and incur more fees and waste even more time. You've got a lot to prove and not a lot of time. An experienced immi lawyer can help immensely in directing you on what the "black box" immigration authorities really want.
