Hello!!!

I have a G4 (diplomatic) Visa and I got married to an American. I have done some research and started filing the applications and collecting the necessary paperwork! I wanted to know if I am on the right track and if I am missing something, also if someone can please distinguish between the documents/proof needed to the application and the documents/proof needed for the interview!

So far I have:

Application for adjustment of status i-485

i-765 employee authorization

i-130 petition

g-325 for both spouses

i-867 (medical forms)

Affidavit of support (i dont remember the code name)

I have a lot of the evidence and the supporting documentation:

passports, employee authorization card for me, electric bill, joint bank statement, we are changing out driver licenses to match the last name and address...

Please help me and set me on the right track!! I really want to make this application go through ASAP.

My problem is that I used to be able to legally work here but since I got married my mom cannot renew my employee authorization because I am considered independent. I have a legal job and my boss is lenient with me for now, but I am not getting paid until I get the employee authorization renewed!

What can I do to get it renewed ASAP?

For a G4 Visa below given are the douements,

1. Online Nonimmigrant Visa Electronic Application, Form DS-160

2.An application for A, G, and NATO Visa, Form DS-1648

3.A passport valid for travel to the United States

So, your G-4 was as a dependent of your mother, right? When you got married, you no longer qualify as her dependent -- so, you may/may not still be in legal G-4 status. If you are not, you could start accruing unlawful presence, so be careful.

You keep saying you are filing -- I assume you mean your spouse is filing, right? You cannot file your own immigrant visa petition.

More importantly -- you say you have a "legal job" and a "lenient boss", which indicates that you are still continuing to work. You do NOT have a legal job if you do not have current work authorization. Whether you're getting paid is, strange as it seems, irrelevant. If you are continuing to work at your job, you are not doing so in legal status. This could cause you problems.

These points are important because, since you entered the US in a dependent diplomatic status, you may not be eligible to adjust status -- you will have to leave the US and apply for an immigrant visa. Section 13 of the Immigration and Nationality Act (INA) of September 11, 1957 was created by Congress to allow individuals who entered the United States under diplomatic status to obtain a green card (permanent residence).

Eligibility Criteria

You may be eligible to receive a green card under Section 13 if you can establish that:

  • You entered the United States as an A-1, A-2, G-1, or G-2 nonimmigrant
  • You failed to maintain your A-1, A-2, G-1, or G-2 nonimmigrant status
  • Your duties were diplomatic or semi-diplomatic
  • There is a compelling reason why you or your immediate family cannot return to the country which accredited you as a diplomat
  • You are a person of good moral character
  • You are admissible to the United States for permanent residence
  • Granting you a green card would be in the national interest of the United States
