in 2009 I was deported under a deportation order for not going to one of my master hearings, I haven't try crossing into the US I have a job here in Mexico, I have 2 US citizens kids 12 and 11 and my US citizen wife, the reason why I was picked up by immigration was because I was in county under two charges domestic violence and for a warrant for driving without insurance I wasn't going to get deport it for the domestic violence or the no insurance warrant I got deported cause of the deportation order

I haven't even tried filing my visa again I been here in Mexico for a little over 4 years now and I'm happy cause I'm with my wife and kids but sometimes I do want to go back to where I grew up I can tell my wife wants to go back too I was so happy cause this year for the first time in 4 years she when and visit her mom and family for 10 days that was awesome they had lost of fun,

I went to the US when I was 14 we only tried once crossing and we made it also I think I mentioned it ever since they deported me I haven't tried to go back and even though at first I was always looking into the possibility of filing I never did and that feeling grew apart but guess it came back cause I do want to file don't know if I'll go through it like all the time I never do file lol

I do know I'm gonna have to file I-130, and hopefully they'll allow me to file I-601 and I-201 waivers that'll be awesome

but I guess the real reason I haven't try filing is for that same reason thinking they will not allow me to file those waiver under my current charge domestic violence what do you think?

Personally, I think you should rethink any hope of immigrating to the USA.

no I haven't talk to any immigration lawyer about this yeah those days are way behind believe me every time I think about it, it makes me wanna cry cause I acted that way towards this wonderful woman and there's no excuses for what I did and that's something I'm gonna live with the rest of my life cause it's been 4 years and there's times that I think about it and it haunts me like if it just happen yesterday and that makes me feel very low

but she knows I love her and we are very happy together that's why she followed me all the way here and we're just loving seeing our kids get older it's priceless

but I will most definitely consider consulting with a lawyer thanks for the advise

Aliens Present Without Admission or Parole [Effective April 1, 1997.]

Under the new INA §212(a)(6)(A)(i), an alien present in the United States
without being admitted or paroled, or who arrives in the United States
at any time or place other than as designated by the Attorney General,
is inadmissible.

this is the paper work I got when I got deported but anyone can over come this by filing the I-601 waiver

what I'm worry is about my charge I talked to the court a couple years ago and they told me they were willing to dismiss this charge if I pay it all in full cause they were gonna take in consideration the fact that I was deported and some guy who I talked to I don't even know who he was but he took the time to talk to me he asked why I never mentioned I was gonna get deported when I went to court for the charge they could of done something about it like probably I could went to trial I just wanted to get it done and over with

You really need to consult with an immigration attorney. It is true you could overcome the ban with a waiver but it would have to show a hardship on your spouse if you were not permitted to immigrate. Since she and the children have been living in Mexico with you for four years what would the hardship be?

As to the criminal charges I have no idea if they would make you inadmissible or not.

Overstay - no problem.

Deportation - no problem.

Both easily wavered.

Legal history BIG problem.

no they don't live here they stay in el paso tx yeah they closer to me cause they visit often I don't think we could live here in Juarez it's not like crazy like the world pictures it but yeah you not protected under any type of law this is a lawless city you got money you pay your way out under any type of circustances you got money you get whatever you want you got no money you get nothing even if you got the right

I stay out of trouble and still have became victim of corrumpted of peace keepers I have been robbed by police several times they took our car I was driving just because it had American license plates and my wife the one the own the car was not with me at the time I was pulled over I had just dropped her off at the briedge and I was borrowing the car and I was put and jail and they wanted to charge me with contranband ####### lol my own car yeah we let them take it and keep it probably they made it Mexican and sold it to someone but anyway this is so sick they come over and they tell me we breaking a deal with you give us money we let you walk out I was like let me talk to a judge they like fine but if you go to prison here in mexico chances are you gonnna be put with real criminal who gonna hurt you if you don't pay them money to stay protected again to get it done and over with we gave them 100 dllrs and they let me go with no car and no charges but what charges they were doing besides contranband supossibily what a joke but that's done and over with car gone no further fighting you not gonna win them

how can you live in a place like this it's beautiful yeah I work here and I like it but no I wouldn't like to stay here for ever my wife has apnea and not taking care of it cause we can't afford it her work insurance won't pay for it I don't know sorry I venting all this out but yeah it would be a great hardship living here my wife doesn't have no family in el paso no spiritual support from no one so it's good we gonna plan a trip for her to go back home for a few days every year

You should speak to an atty, go to immigrate2u.com

they have attys there that will spell out what U face in

no uncertain terms, have u thought of anger management

re: domestic charges, maybe it will help to show rehabilitation,

your wife have medical illness for hardship, the crime stats is

hard on the family especially kids, I don't know what bans u

have nor will I give U false hope , its hard to over-come crime

issues and open cases, it will take time and money , but not

beats a trial except a failure....so ask an atty who is an expert

at I121 & I 601 some of them do have payments plans

anger management should be done I had thought about it I really need to get to it not to show them I'm rehabilitated but for my family be cause I want them to be around family it's sad to look around and you got no family at all to rely on for a honest talk or for any type of support all the people around they always expect something from you that's what I learned

and don't worry about giving out hopes I mean I know where I stand and pretend to keep doing what I'm doing seeing my family still priceless it makes me happy and as I can tell it makes them happy and after all that's all it matter right? but I just know it would be a better life in the other side so I would never lose my hope and keep up the fight I had never let any thing put me down before I won't now
