I'm divorced and my green card is still valid for more than one year. I wanted to remove conditions on my GC.

I already sent the package exactly 13 days ago. I haven't received any response from uscis yet.

What's gonna happen? Someone told me they're gonna send me the package back bc my green card is still valid!!!

But I'm divorced!! Is that right?? And that there's no waiver for I-175 fee that I sent along with the package!!

I'm really confused!

Thanks

You can send I-751 "Petition to Remove Conditions on Residence" to USCIS 90 days before your GC expires, can't send it earlier. Read the instruction for the form.

13 days is really short for USCIS to respond to anything for any reason. You can only wait until you get something from USCIS. My guess is (and this is only a guess) that they will reject your application and return everything to you and you'll have to wait until the proper timeframe to resubmit.

ROC Journey:

4/24/13 - Submitted I-751 application

4/26/13 - I-751 officially filed

6/11/13 - Biometrics done

8/14/13 - Rec'd RFE

9/21/13 - Submitted RFE response

9/23/13 - RFE response rec'd at VSC

(about 2 months later)

11/21/13 - Service request via Tier 1 submitted

12/11/13 - Response to service request rec'd - vague info about processing times

12/12/13 - Service request via Tier 2 submitted

12/10/13 - APPROVED!!! (letter rec'd 12/14/13)

12/16/13 - 2nd Service request response rec'd

12/17/13 - Card production email/text rec'd (online case updated)!

12/24/13 - Notification rec'd via email regarding card mailed on 12/23/13 (online case updated as well)

12/26/13 - 10-yr card rec'd!

One thing I have learned on this journey:

There is no such thing as an "overkill" evidence package. Submit anything and everything you can. Who knows what will prevent you from getting an RFE.

You read the instructions. If he divorced, he needs to send it immediately after the divorce, not 90 days before green card expiration.

Well, HE should read the instructions. I'm not divorced so I guess I skipped that part, therefore I'll try to remove my post so you can start jabbing someone else

Cool guys. This forum is help each other.

Yes, a divorced immigrant can file as soon as he/she gets the divorce decree in hand or 90 days before the GC expiry date, which ever is comes first.
