form I-864 and I-864A - IMPORTANT QUESTIONS!

Hello,

My wife and I are filling out the form I-864. We have some doubts and to facilitate understanding and answers of you, I will try to clarify the situation in a very direct way.

My wife and I live together in my country, she works here and is also a permanent resident. Obviously she needs to fill in this form, but we'll need a co-sponsor (her mother).

My questions are:

1. The Form I-864 will be filled by her and her mother? (same form, not filling separately)
or each must complete their own form.

1. The Form I-864A will also be filled by her mother?

Nope they will each fill out a I-864. Your wife is the sponsor amd hert mom will fil out and check the only co-sponsor box. No I-864A. Mom does the I-864.

Has your wife been filing taxes the last 3 years?

Timeline

The I-864A can be filed by you as the intending immigrant, because you are a member of your wife's (the U.S. citizen's) household. It allows your income and assets to be considered with hers in connection with her I-864. If you have an income and assets, it might be a good idea, because even with a co-sponsor you will want to make your best financial case to USCIS.

Hello,

I have a simmilar problem. I am a US citizen but i do not live there. We live in my husbad's country. An as I do not reside in the US I do not have any income, i haven't filed taxes an I cannot be my husband's sposnor. We want to go to the US but i cannot find a joint sponsor. Can we use my husband's assets which are here where we are living now and can this be possible since I as his sponsor do not meet the requirements?

My understanding is that you are required to be your husband's sponsor because the petition would be based on your marriage. You would be required to file the I-864 along with the required tax returns, whether you had any income or not. Your husband could also file the I-864A so that his income and assets are included as part of your total household income and assets to the extent allowable. If this is sufficient to satisfy USCIS that your husband would not become a public charge once in the US then you would not need a co-sponsor.
