My 2 year Conditional Green Card expired on June 2103

Around Feb 2103 I sent my I-751 form with supporting documents with no common bank account, no common utility bill since both me and my wife never had a joint bank account together, she is owner of the house that where we live together. He has kids from the previous marriage. I would write checks to her every month for the monthly expenses.

So after on July 2103 I received Request for evidence from USCIS requesting for more evidence. Since me and wife were abroad on our trip. So on Sept I sent the documents like

copy of the Medical insurance on which my wife is included.

Letters from 2 persons.

copies of the bank checks that I payed my wife for the home expenses.

Tickets of our foreign trip

A letter from the school that certifies that I am the contact person for my wife's child that was from the previous marriage.

The USCIS wanted proof that we share finances or proof like rent, mortgage bill on both our names. But the house is owned by my wife which she purchased long before our marriage. Also my wife she manages the finances. So all I used to do was write her checks every month for the expenses that I shared with her.

Unfortunately this year we did not do our taxes together.

We do not have our own children yet. We have been trying a lot to have children like treatments and so on. I have submitted that document to USCIS too.

1. The question is how much more time for me to get a reply from USCIS. Note I sent the request for evidence reply end of September 2013.?

2. Are the documents enough for the USCIS to come to a decision.?

3. If for an I-751 application the processing time is 6 months. Then since it more than 6 months as I applied in March will USCIS proceed with my case faster?

4. what are my chances of being called for an in person interview with my wife.?

5. why does the USCIS not update the case on there website.

6. is there a website where they have stats for I-751 cases, like number of application received, number of request for evidence notices issues, approved, denied, and so on?

Hello!

I had an RFE too and mine said that I should hear back within 14 days but I have to wait 60 days before I have to contact USCIS for a follow-up. I would think this is pretty standard so since you submitted end of Sept maybe wait to see if you hear anything back by mid-October and if not just keep waiting, I guess, another 60 days. Based on what I see, those that did get approved hear back 3-4 weeks after they submitted RFE. As for request for an interview, I do not know, it varies.

I can't tell you if the documents you had submitted is sufficient but I know some of us here will probably say no. Personally I would add more. I didn't see you mention anything in regards to how you prove you are living together - credit card bills to same address? Bank statements to the same address?

Also, you can always change your bank accounts to joint any time after someone opens an account. I think that documents showing you are working hard to have a child together can be strong.

6 months is the standard timeframe now but since you had an RFE I think it will take longer although I don't know if it resets.

USCIS doesn't do a very good job updating their sites (as is the case with a lot of people) but they do inform you of their decision. If you like, you can sign up for a case update to send notifications to you via email and text - usually before you get it in the mail, but there are times USCIS doesn't do a good job there either.

I've tried to see if there is any place you can see how many cases USCIS received for each specific application but I have found none.

So unless you feel the need to submit more evidence, I don't think there is anything else you can do but sit back and wait :) Good luck!

ROC Journey:

4/24/13 - Submitted I-751 application

4/26/13 - I-751 officially filed

6/11/13 - Biometrics done

8/14/13 - Rec'd RFE

9/21/13 - Submitted RFE response

9/23/13 - RFE response rec'd at VSC

(about 2 months later)

11/21/13 - Service request via Tier 1 submitted

12/11/13 - Response to service request rec'd - vague info about processing times

12/12/13 - Service request via Tier 2 submitted

12/10/13 - APPROVED!!! (letter rec'd 12/14/13)

12/16/13 - 2nd Service request response rec'd

12/17/13 - Card production email/text rec'd (online case updated)!

12/24/13 - Notification rec'd via email regarding card mailed on 12/23/13 (online case updated as well)

12/26/13 - 10-yr card rec'd!

One thing I have learned on this journey:

There is no such thing as an "overkill" evidence package. Submit anything and everything you can. Who knows what will prevent you from getting an RFE.

Last month, on 9/21/13. They rec'd it the following Monday. I filed in April 2013.

I definitely will, I'm giving it until 10/18/13 if I don't hear anything before then and then I'll keep checking after that until my 60 days is up if I still don't hear anything.

which month did you send in your RFE.? Also plz do post and let us know if you hear anything from USCIS. I will do the same whenever I hear from them.

I just received a text and email message that my case status has been updated. I logged into the USCIS website and this is what I see.

we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.

I am really happy. Wish the same for the others too.

does anyone know will I receive a USPS tracking code via text and email or on the online case update site?
