I am not sure but I lost you on couple of the points, why are you talking to visa consulting services if you are going for L1 than it should be just your company and your company’s lawyer.

Sang could be anything until you more details are provided cost or sometimes the multinational company would post a job in different country but they are not only for local folks, company is not looking to move ppl from different country.

B1/2 – One is not allowed to work on B1/2 it is only meant for conducting business meetings, training etc.

I am not sure what they told you going via Canada, that just does not make any sense at all.

The reason why i went to a Visa processing company was to get some input from a company who has done this before. I know i dont have to do anything but i still want to get as much information as possible. They did supply some information but it wasn't entirely helpful or, potentially, correct. I will not be, and never had intentions to use one for the application. I have absolutely know idea why they mentioned canada.

Ok so as i thought shaky (illegal) grounds for using a B1/B2 for this sort of thing so thats off the cards then.

I am pretty certtain that money isnt an issue, i would be very supprised at least as the UK company has already offered to help with this (lack of communication). If money is the issue then i would be more than willing to fron this myself so i wouldnt see this as a 'snag'.

I have now offered taking myself to go to an immigration lawyer to find out if this is possible. I am unsure if they have gone down this avenue yet but i would imagine they havent. Until this happens i dont think anyone will know if its possivble

I have a BSe in Chemistry and i have been working in health care IT for 4 year permanently as a Team leader of an editorial department. My team consists of pharmacists and biomedial gradurates. I am heavily involved with the work that the US company does and have more knowledge of what they do than the UK company. I also have working knowledge of the middle eastern health care IT market which is something being worked on between the UK/US. I would be going to an implimentation specialist position in the states.

Sounds more like HR do not want to play.

“If you know the enemy and know yourself, you need not fear the result of a hundred battles. If you know yourself but not the enemy, for every victory gained you will also suffer a defeat. If you know neither the enemy nor yourself, you will succumb in every battle.”

I think you need to push to find out what the issue is believed to be. Ask your potential boss in the US for more information, or at least who to talk to. If you don't yet have someone in the US who actively wants you over there, then I would say that "an opportunity to move to the US company" as you mentioned in the first post doesn't really exist any more.

My take on the information is this:

1. Going on the information supplied, you are probably eligible for L1-A (manager/executive) and maybe eligible for L1-B (specialized knowledge professional), but I'm not sure either is definite.

2. Companies move staff between countries for three main reasons: firstly, because the expertise is not available in the destination country; secondly, so that the worker can gain experience internationally for career progression; and thirdly, to ensure company culture and procedures are similar throughout. For many companies, the latter two reasons are unimportant. So, you might want to move to the US, but unless they are unable to recruit locally, they may see no reason to move you.
