AOS in Process, Leaving Country?

Hi All,

Ok, so we have filed for AOS. My now wife came as a visitor for a few months. We had an unplanned pregnancy (very happy about it, but still unplanned). Got married legally in front of a judge. Filed AOS. Now here is the kicker, I got offered a good job in the Cayman Islands.

So here is my question:

I realize that it will be abonding the AOS process, BUT will we have less time to wait if we decide to come back in three years, since they got our info, AND more importantly she has had a biometrics appointment?

If not, can I apply for the K3 while we are still in the Cayman islands AND how long does the K3 typically take?

I just don't want my wife and young child in another country for an extended amount of time alone, since I am the sole bread winner.

I don't think it will make anything faster if you had an earlier petition, although I don't know.

K3 could take 6 months or so, maybe more, maybe less - who really know in 3 years, things change so much.

Finally, maybe your best option if you'll be living in the Cayman Islands, if it is available there, is filing DCF.

02/05/07 - mailed DS-230 to NVC via express mail

02/20/07 - CASE COMPLETE!!

Having your info means nothing and having had a biometrics appointment is not important.

You might want to have a consultation with an immigration attorney to see if any other facts of your situation are important, especially any facts that may be significant in a negative sense. How long has it been since your wife's allowed stay as a visitor expired?

Yodrak is right..... you need to be careful because if you abandon your wife's AOS then any days from the day her visitor visa expired will count as days out of status and if more than 180 days it could trigger a ban on re-entry... you do need to consult with an immigration lawyer to check out your situation before she leaves the US...

Most people who do AOS from a visitor visa are advised not to leave the country until they have their Greencard...
