My question is straight and simple does constitution protect the (immigration rights) of an individual who has entered country illegally?

What does the USC say about immigrants and their rights? In fact, does the Constitution state to whom its articles apply? That might be a good starting point for your research.

The US constitution already does that.

What does the US Constitution say on the matter?

Of course, you can always go with the blog used as the premise of this thread.

You are the one who said USC does that but never mind you cannot answer a simple yes or no question.

Now you are rewriting the question. The Fourteenth Amendment guarantees due process and equal protection under the law, to all persons present within a state.

You know, ESL classes at your local community college are a great way to increase your comprehension of the English language, as it is used in the US.

Pretty funny how they call it "Non-Citizens" when in reality it's people who broke the law by entering without inspection.

2) Under 8 CFR 235.1(a) an alien must apply in person to an immigration officer at a designated port of entry at a time when the immigration office at the port is open for inspection. Under 8 CFR 235.1(d) he must present any required documents and establish his admissibility to the satisfaction of the immigration officer. The immigration officer must be afforded a full and fair opportunity to question the alien. See Matter of F– , 1 I. & N. Dec. 90, (BIA AG 1941).

People can't simply break a law because they think it's unfair.

Pretty much, unless that was the only way to allow your spouse or fiancee to legally enter the US. It's pretty sweet to be able to start the clock for citizenship at three or five years, instead of waiting for a general amnesty (probably won't happen) or a defined path (more and more likely) to be agreed upon by Congress.

People can't simply break a law because they think it's unfair.

Done with a wink and a nod, in places like Washington and California. We need the laborers to do the work unemployed people refuse to do. I know it is not the money - the money is pretty good, but it is hard work, which American's don't seem to want to do anymore, especially when the government gives them money not to work.

California has been importing labor since it became part of the US, from China and Japan, later the Philippines, and now Mexico. The only people we didn't like coming here were the Okies.

Due process would be they are in the country illegally, violating the existing law and they should be deported back.

Due process is not creating a path to citizenship for them …. Unfortunately ppl like you do not understand that.
