Hey everyone.

I have a couple of questions regarding this process....my fiance and I want to apply for the K1...IS it really necessary to get a lawyer to do this for us or is it

something that can be done without spending the $2000????

Also if my fiance already has a business visa is it still possible to apply for the K1 visa? will having the other visa hinder anything?

I am new to this process so I need to know what I am getting into...thanks!

If there are nothing complicated with your case, then a lawyer is not needed, I am not using one. I used the guides here, and bought a legal book "Fiancé & Marriage Visas: A Couple's Guide to U.S. Immigration" NOLO Book

K-1 visa is a fairly easy one to apply for, nothing complicated.

Is now a US Citizen immigration completed Jan 12, 2012.

Hello, I don't think you need a lawyer, because everything you need is on this site and any time you have a question, come here and post, someone's bound to answer. Browse around, I have found a lot of the answers to my questions, reading old posts. This is a great site. I think the only reason you need a lawyer, is if you have a criminal background or things as such. Look under Guides and you'll find some info. for getting started.

I am not so familiar with, if your fiance is having a business visa, but I believe on the I-129f, it asks if the fiance has ever been issued a visa, I would put it on there. Someone will probably answer that question a little better then I can.

Possession of a business visa will not impact the petition process. You don't need a lawyer unless you have complications in your case but it never hurts to have an initial consulation with one to be sure. I would suggest one in your case due to the work visa and to be 100% that there will not be any problem traveling to that US with this visa while the K1 is pending.

Spend some time reading through the guides to develop an understanding of the entire process.

About the NOLO book - I've never seen it firsthand but I've read several posts indicating that there are many errors in the book (or perhaps it's outdated).

Thank you so much for the advice...this is going to be a totally new experience for me ...I just want to make sure everything goes ok....it sure sounds intimidating....all the paperwork...the whole process in general....if you don't mind I'd love to keep in contact with you...you sound like you know what you are doing!

could be true about the book, I was checking the site she gave and it says the book went out in 2005, well things have changed, I am sure since then. There probably are some things that are out of date or incorrect. Thanks for letting me know.

Why dosen't your fiance enter on the business visa and then you guys could just get married.

Why dosen't your fiance enter on the business visa and then you guys could just get married.

Because a Business Visa is to do business in the US and allows him to travel back and forth for his job which it looks like he needs to be able to do. Filing the I-129F and going the Fiance Visa route should actually make it easier in the long run based on that need.

We could do it this way but I've read that it takes longer to get the work visa for him to be able to work here.....and that is very important to him and I. I guess I've just been comparing different options and the k1 seems like the shortest route for us. Maybe I'm wrong but I think I read that if we marry in the US he will have to return to Spain and then we have to apply for the K3....I don't want to take that chance...If we are married I want to be together not in different countries....

I replied to the wrong post...haha..these boxes are confusing..oops...anyway .... when my bf went to get a visitor visa they accidentally issued a business visa for whatever reason....but either way he got to come to see me finally...now we want to apply for the k1. This long distance is really hard...we just want to be together and we know we want to be married. People get stressed over planning a wedding...can you imagine the Bridezillas we would have if everyone had to worry about getting a Visa on top of that? It will be worth it tho.
