Dear VJ users,

We do need help!

My Financee lives in Florida, I live in India. I { 32 yr old Indian man.She is an American 33 yr old. We are single (never married before)} attended the interview in Mumbai,India for my K1 visa on 11th Oct 2013. The interview officer asked me only 5 questions about

1) How we met first time despite distance? Answer: Online forum

2) Why it is with American Woman? Answer: Its nothing to do nationality to share individual views and experience.So we talked to know more about each other and we wanted to move on in our life.

3) Did she meet your family? Ans: No. During her visit to India, we travelled northern part of India together. My father only lives in Southern part of India ,who doesnt speak English. I live seperately since since my mothers death in 1998.

4) How your family feels about this relationship? Ans: Happy.

5) What about the Wedding plans? Ans: We are waiting for the visa to get married.

Then the officer gave me a letter stating that our documents are going to sent back to USCIS for the possible reviews in few weeks.

Now Me and my Fiancee are restless with this not knowing the timeline of this procedures not knowing the outcome being very anxious in our case.

What Happens When a Petition/Application is Returned to the USCIS by an Embassy/Consulate after the Interview of K1 VISA?

We are thankful for the fellow VJ users helping us in our case.

I hope you will ask the mods to move this and begin your own thread.

Your situation is similar to the other case of course. Like that case I would think you would see where your case is going. Back to USCIS as you said. There to take months to review and then result in a denial. These cases are decided at the embassy level really so if there was going to be an approval it would have happened there. I know sometimes these cases are sent back again by USCIS for possible approval but who wants to sit in limbo for many months just to see if they were one of the very few?

Question # 2 is where the decision was made I think. Your answer was honest but inadequate for the officer.

Take the advice given to others here and consider getting married in India and then file for a CR 1. Otherwise just sit back and wait for as long as it takes.

It's more than that...this is the 21st Century. Consider this site for example, you all have been giving me great advice for the past two days now. Without this computer, or the computer your on could that happen. We live in a world of on-line this and on-line that. Our kids of today are meeting kids from all over the world using social media networking sites. Today you don't have to fly 8000 miles to see the person you love, you can log-in and see their face, you can hold a conversation, you can laugh and share, just as easily if that same person was sitting next to you. That's what I have, Months of Vonage phone bills, hundreds of pages of on-line chat, emails, short stories I've written him about us, cards, gifts, and yes we did get to meet, to touch, to hold and feel. I miss that the most, and I can't wait for us to be together again. How do I send that in a form and how does he express that through a bullet proof window.

But to answer your question, I would kill him. :-)

OMG I can relate...Despite all our proof (which she didnt seem to care about since she noted his religion) we were denied because she felt it was highly unlikely that 2 eople can decide to marry after only 15 days as she put it.. We were talking face to face online 9 months before my trip to Insia and over a year after this we still have current phone/chat/email history.My children even send him pictures and chat with him too..The interviewer saw the pictures they collored him..said oh how sweet..then denied us saying not enough proof of a relationship..I mean come on?almost 2 years!!!!not enough proof??she asked him repeatedly about his religious practices...that strikes me as a bit odd considering they claim they do not and may not discriminate based on color,religion age or gender...as per US law.She clearly did.I wrote and called the consulate.we'll see what they reply

Interesting that you say that. With my limited experience in these matters, I am interested to know why you think so, and what a good answer would be instead, and also how you think answer #3 factored in, if at all.

Generally giving "right answers" on a forum like this just helps scammers who read as guests.

8 years, I don't think that is significant.

8 years is certainly not considered significant...unless your a woman 8 yrs older. then they seem to make an issue..happened to me..Im actually 7 1/2 yrs older.but then they went on religion too.all illigal BTW.according to my senator but I guess US embassies think they can do what you want.As the person in my congresswomans office said..in matters of immigration you are guilty until proven innocent..its horrible.Im waiting to see if she can do anything..Good luck to you both..

looks that way.. she asked him lots of questions about his practice of Islam..does he affiliate with a particular group,Would he call himself a "follower "of Islam,and does he pray as a muslim..all questions they asked..when he said one of the many things he loves about me is even thought he is Muslim and Im jewish we understand eachother and respect eachother so well.. he was going to elaborate but the CO exclaimed"WHAT??!!!?? shes JEWISH?? he said..yes, she is jewish. interview over.. she handed him the paper that said the case will be sent back to USCIS for possible revocation.she said we didnt say this in our application with USCIS.well, Ill be damned but where in the application does it say disclose your religion?

well actually Ive seen it in a few places where someone was hindu and other christian..maybe there were other factors.. but certainly she was fixated on this with us.I dont believe the whole"I dont believe you want to marry a woman older than you with 2 kids.." she said this.. Im 7 1/2 yrs older.. not that bad ok? we had solid proof..at least we had everything the website and my lawyer advised us to bring.looking back now I am thinking letters from my family and his might have been helpful but the thing I dont get is why parental approval is so important when your dealing with adults??happens to be my family is thrilled.they talk all the time.he calls them mom and dad.. but apparently knowing my family and children and all the evidence we talk daily wasnt enough proof of strong ties and relationship in the US.My brother and now sister in law had no issues like this..their experience was a piece of cake.my whole family is shocked.. we are devistated

I have never been to India, I had Indian friends in the UK and certainly there marriage choices seem to have involved the Family. I was forever hearing about the pressure from Mother.

You sister in law is Muslim?

I have never been to India, I had Indian friends in the UK and certainly there marriage choices seem to have involved the Family. I was forever hearing about the pressure from Mother.

my sister in law is christian. His family would have preffered to pick his bride.He was working since age 14..lived away from home most of the time.He managed to get an education and support his family.he's his own man.when you spen 15 years away from mommy.. you respect her and love her but if your the supporter of the family than her opinion counts but HE felt he had the final say.She likes me.. but would rather I not be his bride but remain a friend. Hes a little different than a lot of his family.Actuallly his brothers are also very open minded...depends on the person.India is not like it used to be.

Sad news for us my fiancé had interview 12/16/13 India Mumbai unfortunately he got letter that stated his document will be sent to back US consulate. A lawyer helped us the process now that we get denied she is not even willing to talk to us in regards of what do. We are lost and not know what to do. What a pain. The only thing that I can think of is I have kids and divorced. we have a good evidence phone, email and pics. We also met in person once. my Lawyer told us we have enough proof but not sure what get wrong.

Should we wait until we got the mail of why we were denied or consult with lawyer? should I call the embassy? Please advice
