Hello all,
My husband and I have been married for 3 years and have a baby together, the baby has his US passport and we're looking to move to the USA ASAP. My husband has ILR (with BRP) and is applying for naturalisation this week (he's been in the UK for 7 years, four as a student, 3 as a spouse), his company is UK based and is transferring him to the US office.
Couple of quick questions....
Your pack will include any of the following (*asterisk is an optional item, depending on your specific case):
  • Completed I-130 form by petitioner
Address in the United States where your relative intends to live. We don't have this yet, as we want to move out together, or at least my husband doesn't want to move out until we're closer to having the visa. What do we put here? We can put his mother's address but we don't intend to live there. (It's in Texas, we're moving to California)
  • Evidence of petitioner’s US citizenship (birth certificate or copy of biographic information in passport)
We have both of these, I understand that London doesn't want certified at this stage, so they're just straight photocopies, correct?
  • Evidence of petitioner’s UK residency (photocopy of visa and entry stamp is ideal - they want to see how long you’ve had UKBA entry clearance)
This is fine, we can photo copy the BRP, his original entry stamp is seven years ago, with his student visa, do they want this or is ILR BRP photocopy enough as you need two years of FLR to be eligible for ILR?
  • Marriage certificate (photocopy only)
We were married in UK and have this.
  • 2 x G-325a biographic information forms (one each, both with US-sized photographs attached)
Fine. These have been endorsed by a CEO/Bank official
  • Divorce decree(s) for any previous marriages for either petitioner or beneficiary*
N/A
  • E-notification form G-1145 with petitioners email*
Fine
  • Record of any name-change if different from any official documentation*
I kept my maiden name after marriage, problem?
  • Payment form ($420)
Fine, we're using a US debit card to pay, problem?
  • Ticked-off checklist
Fine
  • 1 self-addressed envelope with a first-class stamp attached (this will be used to send you your NOA1 approval notification). Address to petitioner.

I-864 Affidavit of Support
On the financial side, my husband could get a letter from HR showing his salary plus payslips and stating his salary in dollars will continue once we move, is this enough? It's well above the poverty limit requirements.
We also have about £20K in available savings.
Evidence of domicile - Well, we're selling up and shipping stuff so I have quotes on this, he's kept and recently renewed his TX drivers license, he's always filed taxes, he's kept both a credit card and his bank account open over the years, we've visited at least once a year, anything else?

Okay, I can definitely help out with some of these, but some more experience DCF's will chime in as well! smile.png

Yes, photocopies are fine, they don't need any originals at this stage.

Evidence of UK residency. Yes, they will want to see the entry clearance stamp on your passport (photocopy the page), if it's expired, you will need to show your BRP as well smile.png Show everything you can.

*Marriage certificate is good, just a photocopy smile.png

*G325A forms... sounds good. Did you write your full names on the back of each photo? You can do this with a pen, but just write lightly to avoid it coming through to the front.

*Not sure about the keeping your maiden name... my passport still had my maiden name on it, but they didn't seem to care.

Your marriage certificate should act as fine enough... someone will correct me if I'm wrong smile.png

*They don't accept debit cards for payment. You'll need to use either a CREDIT card, or use the other options, such as an international bank draft (this takes about 3-5 days to receive)

*Not sure about the I864 question...

*As far as domicile... how about voters registration? Drivers License? Movers quotes? Bank accounts... basically anything that is a tie to the US smile.png

Now, on a personal note... it doesn't say to include anything else with it, but I received an RFE for affidavits. So you might want to just throw an affidavit of bona fide marriage in there, with a few pictures. Just to be on the safe side. You don't HAVE to though smile.png

Also, for some extra points, you can include a cover letter "To Whom it May Concern" and state what you have put in the packet, and explain that if they have ANY issues or concerns that they contact you on the below information. Include email, phone number, address, ect... :)

Yes, that lets them know his income will continue in the US so they can count it. Also remember to include his latest US tax return.
