Possible Impact of Diversity Visa (DV-2015) on E-2 Investor Visa

We were planning on entering the Green Card lottery today, but our immigration lawyer has advised against it as we're planning to apply for an E-2 Investor visa next year.

The lawyer advised:

Because the E-2 is a non-immigrant (temporary) visa and the DV is a permanent visa. So the two intents conflict: temporary vs. permanent.

The thing is, we have already applied for the DV but it was a long time ago (DV-2006, I think, in 2004).

We really would like to apply for DV-2015 but don't want to damage any other (presumably more certain) chances. Does anyone online here have direct experience of this & could confirm or challenge this?

If your British, unless Northern Irish, I believe you can't enter the Diversity Lottery anyway.

This is usually true, but my wife is Slovak and I'm allowed to enter under her nationality.

Ah okay, If you are going to Qualify for an E-2 id just go for that.

Why - do you think applying for the DV will damage my chances for the E-2?

Although the odds are small, entry is free and if selected in the DV, I'd be able to apply for a green card. With the E-2, I believe I'll have to re-apply for the visa every 2-5 years, and my kids won't have the right to stay in the country once they're 21.

Yes thats true, Every 2 years. I have a friend who applied for both DV and a non immigrant visa, he was denied the non immigrant but happened to be selected in the DV. I can't remember why his application was rejected though.

Cool. Well, let's hope it wasn't because he entered the DV - or I'll need to be just as lucky :-)

entering the DV has no affect because unless you are selected ( unlikely ) you have NOT applied for any US visa and entering is a non reportable event.

This will not be over quickly. You will not enjoy this.
