Tourist visa gamble????

Timeline

Not looking for how the process works,cos already brought father-in-law here on tourist visa,just trying to see if anyone has had success bringing someone younger over to the states on tourist visa, my sister-in-law is 45 has no real ties to Vietnam and no property neither, so trying to gauge if it's worth the $160 gamble?

10-26-2010: I-130 approved

01-05-2011: SIF & CC

04-28-2011: Interview date April 28,2011 @10:00 am APPROVED

Like you said it is a gamble. Living here and knowing many people who have tried and failed I would say it is not worth it if you don't want to lose $160. I work for an International company here in Vietnam and we send many Vietnamese employees to work abroad in the US for 3mo, 6 mo, or 1 yr, stays. Many times even with our company sponsoring them they still get denied. The lucky number seems to be 3. After the 3rd try many are finally accepted. Not sure how true this is for everyone, just stating what I see in our case.

Every situation is different. If she has NO ties to Vietnam then I highly doubt she will get approved. However, does she have any travel history? Has she left the country for travel before then returned? This could help her case a lot. It shows a history of returning.

Anyway this is just my opinion and experience from living here in Vietnam and knowing many people being denied for a tourist visa, including my wife. I'd be interested to hear what others have to say about this too.

06/05/2013 RFE issued

06/25/2013 RFE recieved in mail

06/28/2013 RFE requested docs. sent to USCIS from abroad

07/08/2013 RFE entered into USCIS system as received and "RFE Review" status online

07/16/2013 NOA2 received by email

07/19/2013 Email from USCIS stating case file has been sent to NVC

07/27/2013 Hard copy of NOA2 recieved abroad (Vietnam) by mail

NVC:
08/02/2013 Received NVC case number via email

08/02/2013 Sent DS-3032 via emial

08/05/2013 Paid AOS ($88) fee

08/19/2013 DS-3032 accepted by NVC

08/26/2013 Paid IV ($230) fee

09/04/2013 Completed new DS-260 Online in place of the old (DS-230 paper form)

09/10/2013 I-864 Sent

10/04/2013 Check list

11/02/2013 Check list

12/14/2013 Case Complete

12/30/2013 Interview Scheduled for Feb 25 2014

US Consulate HCMC, Vietnam

02/25/2014 I-R1 Immigrant Visa interview (APPROVED!!)

03/06/2014 Visa delivered

I don't like to be negative but based on my experience I think you will be wasting your 160 dollars. My wife, then gf, was denied a tourist visa. We were informed that all nonimmigrant visas are treated as immigrant visas until you prove otherwise. We thought we had substantial evidence for her to return to Vietnam. That being said every case is different. Good Luck.

5-3-14 Received DS-261/AOS bill

5-3-14 Paid AOS bill

5-8-14 Received IV bill

5-8-14 Paid IV bill

5-9-14 UPS documents to NVC

5-10-14 Sent DS 260

6-12-14 Case complete

9-8-14 interview---- approved

She's your wife's sister. That means if your wife decides to sponsor her with a sibbling petition (F4), it prob would take somewhere between 12-14 years to complete the petition.

So if you were a CO, would you approve the sister-in-law for a Tourist Visa?

(knowing that above fact and the possiblity the sister-in-law might stay behind here in the US with this much shorter cut). Your sister in law might not have the intention to do this but unfortunately many others have done it the past.

So by bring them here, you're meaning "sucker USCIS into letting them into the country on a tourist visa but they never leave?" That's kinda what it's sounding like.

November 14th, 2013: She's here!

December 12th, 2013: Picked up marriage license.

December 14th, 2013: Wedding
