Thanks, Saylin, you were right, having my wife here for Thanksgiving, was asking too much. I guess, I'll have to settle for sometime in Dec yes.gif Just got off video chat, with the wife, she's still on cloud 9 !

Woohoo! Received my 2010 and 2011 tax transcripts in the mail today. Don't ask me how since IRS has been closed!

So my hold up is my joint sponsor(dad and stepmom) supposedly they never filed 2012 return so their accountant is working on that now. I COULD sponsor my husband on my own and make well above the 125% poverty rate but only since June. If their accountant takes too long to get their documents do you think I would have a good chance of being okay if I just sponsor him on my own, submitting pay stubs and employment letter even if my tax returns do not indicate much income in previous years?

Thanks! We definitely are lucky! I hope NVC receives your case soon.! I too was told 8 weeks on the phone and they received mine in about 3 weeks.

Grats! I'm guessing the IRS had mailed them out before the shutdown. Very lucky ;)

If you've been earning enough since June, it's definitely worth a shot! NVC will likely approve it, and you've got a good shot at the interview, although the embassies/consulates can be more strict when it comes to the I-864. I'd suggest: send off the AOS package asap with just you as the sponsor. If it's accepted, awesome. Bring joint sponsor documentation to the interview (hopefully your dad and stepmom would have everything by then for the interview), and only hand it over if the officer doesn't like your income and asks for a joint sponsor.

If by then I still doNt have their documents then I will mail everything (both packages together) as is. While I submitted the DS-261 over a week ago, I accidentally went back into it a few days ago and resubmitted it (without changing anything). That's awesome! Good to know I have a strong chance of them being fine with if. I mean, I was a graduate student for those 3 years trying to get a good enough education so that I can ALWAYS take care of my family with a stable career.

I guess my plan is to wait until I get invoiced for the IV package and when my husband can complete the DS-260. If by then I still doNt have their documents then I will mail everything (both packages together) as is. While I submitted the DS-261 over a week ago, I accidentally went back into it a few days ago and resubmitted it (without changing anything). Sounds like a plan good.gif In the AOS cover letter, point out that you've been a graduate student for the past few years, but since June you've had a stable job that is over the poverty line. Just a sentence or two is fine. Not sure if the officer will even see it, but whatever! I wrote something similar in my husband's AOS package, so.

Couple of questions

Currently waiting on NVC to receive file. and also filed for Naturalization.

Looking at the time frame I'm expecting to be naturalized at some point while my case is pending with NVC/Consulate. I know i can "upgrade" my application/petition by calling/emailing NVC.

Should i be concerned( like any additional documents filing or any other issue that can cause delay??) if I become USC after

  • IL Letter received.
  • Right after Interview.

Also

What should be done in cases where there is an employment change after AOS has already been filed??
