We filled her gross earning from July 16 2013 till September 19 2013 before we mailed it. The figure we quoted was same as the amount in her annual report

Unless I missed it, I didn't see anywhere where it stated about including 2012 tax returns. It does appear though that you didn't fill out the I-864 form correctly. Did you not fill out 13a-c?

If you check carefully you will where 2012 tax returned was mentioned. Of course we filled 13a-c to the best of our knowledge. I am reviewing what we filled to see if there was any error. Thanks

They are askign because you put doen earning. Unless she made above the amount needed to file (i believe like $9000 or so) they you should have put $0. And than the letter attached would have explained it more to them. Since you reported earning they wantto see a tax return. So you need to explain it more.

Oh really? We included 4 of her paystub and the total earning was less than $2000. The annual report served as letter from her employer.

You are telling them on one had I earned money and the other hand we don't have to file because we didn't make enough. You have to make it plain to them. You needed to put $0.

Am I write people? NVC wants a tax return. They aren't tax people soi they have no clue what the guideline amount rewuired to file so you have everything submitted to them they are expecting a tax return.

Let me get this right, please pardon my naivety. If we filled $0 dollar as amount earned then should we include or exclude the 2 month paystubs and letter from employer stating her gross earning till dat?

Thanks

In addition please can you or someone help to direct me to the IRS PUBLICATION stating what minimum gross earning is needed for filing tax return? Thanks

That's much clearer wink.png But yes, it'll obviously reset the clock as they now need to review something else. Whether it will actually take as long as the time frame they give out over the phone, who knows. Could be faster, could be slower. Just keep calling once a day (or as often as you want) and asking for any updates.

Actually, looking at my form, unless they've changed things, they actually ask what the present occupation is of the beneficiary. I chose 'not employed'. So, there's no dates to input.

Did the A number appear on the NOA2?

Yes, just checked NOA-2, the A-number is given with my name. I guess that means I include it in the i-864. Thanks.

For question 13a-c, the numbers are based on PAST tax returns. If she's only worked in 2013 so far, then there's obviously no 2013 tax return. The I-864 wants the past 3 tax years, which is currently: 2012, 2011, and 2010. If she's not worked those years (or has been under the threshold), then you put $0.00 for 2012, $0.00 for 2011, and $0.00 for 2010, as she doesn't have tax returns for those years.

You do put her CURRENT income on question 5 though as that's not based on any tax return, but rather what she's currently earning.

I'd suggest including the letter again stating that she's making under the limit, thus has not filed any tax returns.

Yes, just checked NOA-2, the A-number is given with my name. I guess that means I include it in the i-864. Thanks.

Alright, if they included it, then I suggest you include it as well (stay consistent).

Be aware though: they may assign you a new A number when you get your visa/green card. Cause it happened to me. I had an A number assigned to me when I got denied the first time at an airport, and that's the number I used on all my paperwork. But, when I got my visa in my passport, I noticed I had a completely different A number. I'll be honest, it freaked me the heck out, but asking on VJ, I was told this is normal and happens sometimes. So, thought I'd share ;)

Unless there are problems, I think Valentine's Day is a definite possibility! And although Christmas is highly improbable, there's always a chance someone can cancel their interview (in December) and he gets assigned their date smile.png

Crossing my fingers for that to happen!!! dancin5hr.gif

Hi,

So packages were according to fedex received this past Friday- so basically NVC have had all of the docs for 3 working days now. What's next? Sit and wait a couple of weeks before contacting them, and wil the status change online once NVC completes the case?

Praying to be home together for Christmas :/

thank you.

Good luck, dance of life. I'm a step behind you. Sent AOS package, but only got billed for IV today, so I'll send that hopefully next Friday. Have to wait for some docs to be mailed to me from NL. Let's keep each other in the loop. I was hoping for the same news, but I'm thinking I am being too hopeful now that it's almost November. Good luck! goofy.gif

If I were you, I'd count from the date NVC says the civil docs were added to the casefile, and not the date the DS-260 was submitted online. How to get that date? Call into NVC, and ask:

--Did you receive my civil docs?

--What date were they received?

--What date were they added to the casefile ?

--What date were they reviewed?

IMO, that gives you a better idea for what's what. IMO, using the date the DS-260 was 'done' at the CEAC website is not a good timetick for any metrics.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Hello OCT filers,

Just received checklist for I864 (silly reason: wife forgot to put N/A under sponsor information).

She sent in the corrected form on OCT 25. Does this mean that my case complete date has now been pushed to 20 days later or will I be put "back in the queue"?

Thanks.

The checklist instructions I received in the email said "allow 20 business days from receipt of documents" for NVC to review any compliance on the checklist.

I was on a call with NVC yesterday, however, and the operator said as soon as they receive my papers, I should be looking at 30 business days.

So, in short, looks like our papers probably will be back on queue--how else could it be if it really takes that long? oops8rh.gif
