We waited for the very same reason. While I sympathize with you, at the same time it is nice to know someone else got the same kind of answer from SSA.

Interesting that the field offices would have the final say. I think there is no final say, and each has their own interpretation of it!

Success at last! We followed the trusted advice of Yodrak (Thank You).

We went back to another local SSA office. We didn't mention anything about being married, listed her last name, instead of taking mine and it went through without any problems. We'll worry about changing the name at a later date.

We went to get Marlene's SSN a few days after we were married. We told them we were married and we applied using my surname and listed her maiden name in the "other names used".

The lady at the desk told us she was no longer K-1 status and didn't qualify since we were now married. I disagreed firmly with her and notified her that the her I-94 gave her status until it expired and was not nullified by marriage. I demanded that they put the application in the system and we got the card a couple of weeks later.

It looks like your firm approach was enough to get the SSA to act and try it through the system. We tried the same argument the first time, but with no success. They wouldn't even try the system to see if it would go through.

Congrads to you STL!! I am glad you succeeded. Now you can concentrate on getting your financial accounts in line (for AOS interview) which will make it much easier once you recieve your SSN.

J&M, just want to say I am also happy tht you also succeeded with persuading the boneheads at SSA. I guess since they dont do many K1's (or maybe some just enjoy making life harder for others), they are not very well versed in the regulations so it seems. But regardless, it is nice to see one of us persevere.

There will be a problem with her applying using your surname - the SSA will have to confirm her status with the USCIS SAVE data base and that database will still show her maiden name for awhile, until they update it based on her application to adjust status.

Apply now in her maiden name and worry about changing the name later, perhaps after adjustment is approved and she'll be wanting to remove the notation about employment status. For now, just get the card.

Hi...

I just called my local Social Security Administration Office (McKinney, TX)...and followed up status of my request for Social Security Card...gave the attendant/representative my reference number. After checking my reference number and spelling of my name (first, middle and married) for about 5 times, he told me that they just received an overnight confirmation from USCIS of my status and they will reproduce the card now. He told me that I can pick it up tomorrow and just bring my passport. He said that it will take 2 weeks for me to receive it if mailed. It took 19 days from application to SS card issuance. I am really not sure how it goes with other SSA offices.

Just wanted to add to this post that I applied for a SSN today, after entering on a K1 and getting married, and I had no problems at all. I was up front about this and the guy who helped me didn't seem phased by this at all. I brought my marriage certificate with me, which he wanted to see along with my passport/visa/I-94. I guess it all depends on where you go and who you see?

Actually, the SS cards are reproduced in Maryland...we can only pick-up SSN print-outs from the Local Office...I picked out my SSN print-out from the local office in McKinney last December 15. They also told me that Maryland mailed my SS card to my home address last December 12. I received in the mail my SS card yesterday, December 18 with my married name in it.
