1-130 Processing Times

Timeline

Hello Everyone,

I just got off the phone with an USCIS representative, and was told the current processing time for the 1-130 was 16 months. That seems much longer than what most people are reporting of this site. Can anyone shed some light of what was said by the representative. Any info would be greatly appreciated.

I really have no idea how long it takes, but from what I hear is that it can take over a year for your spouse to come. However, you can petition a k-3 visa. This is a non-immigrant visa for a spouse whose petition is still being processed, but you have to petition before the 1-130 goes to NVC. 16 months at uscis wow thats the first i heard for that long

ours took about six months and we are four months now at the nvc took us two months to get our approved petition to the nvc..so now we are waiting on a case complete in shaa allah in oct..oct will be a year since we started this process..so i wish u the best of luck..

Immigration lawyer told me k-3 is no longer an option.

Its been a year since submitting I-130 and were still in two different countries :sleepy:

Our entire journey from intial filing to POE will have taken 11 months. I have heard that CR-1's have slowed down recently though, so I wouldn't be shocked if it were true.

I love a guy who looks like he could be on Criminal Minds as either an agent or a killer.

If the petition has not been approved by USCIS you still have an opportunity to apply. Sometimes lawyers do not give appropriate advise. It will no longer be an option if an only if the petition has been approved and sent to the NVC. If you have not received any notification from the USCIS, be it through the USCIS status link or mail, that your petition has been approved, then you still have the opportunity to petition for a K3 visa. You might as well call USCIS to find out your eligibility. Definitely, 16 months is quite long to wait.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

Is your I-130 at Overland Park? If so, that is where the 16 months came from. Most March filers are still in Initial Review.

6/12/2013 NOA1
8/20/2013 Master Calendar Hearing postponed
10/1/2013 MCH postponed again due to shutdown! More time for USCIS to process I-130 before mi amor has to take VD.
12/24/2013 Case transferred to CSC (60 days is 2/22/14)
1/23/2014 USCIS transfer notice 2 back to NBC (Lee's Summit)
1/27-28 USCIS transfer notice 3, 4 & 5 - eventually lands in TSC
2/19/2014 New MCH hearing. Voluntary departure by June 19, 2014.
6/6/2014 Finally have the I-130 interview. Approved on the spot! NOA2
6/17/2014 Mi amor left to comply with voluntary departure order... :cry:

Is your I-130 at Overland Park? If so, that is where the 16 months came from. Most March filers are still in Initial Review.

16.6 months is the current national average, as stated by USCIS in the "my case status" section. It is probably wildly inaccurate, but it is the only processing time estimate coming out of the black box. What else are we to go by? Tier 2?

07/29/2014 - NOA1

11/19/2014 - Transfer to TSC

12/19/2014 - NOA2

01/15/2014 - NVC Received (TSC held it for 3 weeks...)

02/19/2014 - Case no. and IIN assigned; requested embassy change

02/27/2014 - DS-261 available and submitted

02/28/2014 - AOS available and paid

03/19/2014 - AOS mailed

03/27/2014 - AOS entered into system

03/24/2014 - New case no. assigned

03/25/2014 - IV fee invoiced and paid

03/28/2014 - IV package sent via FedEx

04/26/2014 - case complete

06/01/2014 - passed interview

Explain to us more about Overland Park?

Its a service center that just opened for processing I-130 (I mean it was there just not doing I-130's) thats about it. No different than the others just main focus will be I-130 like how they did with Lee Summit, Missouri before that got all hosed.

Thank you dwheels76. How come the Processing Times for I-130 - IR1/CR1 is not in the USCIS Time Table at their website? Are they not processing any now?

I would gather probably because its too soon. It's only been 14 months since I-130 went to Lee Summit, Missouri. And all the local offices. Don't take their 16.6 months they have posted that is an estimate.

No there's been many IR1/CR1's approveved that filed January through April. But seems nothing since May filers and forward. At least no one is reporting it. And I have been checking. But no not 16 months.
