I have a question. I have received an RFE for I-485 regarding to my birth certificate. I submitted an affidavit from my father in my application as a proof of birth. However, the RFE indicated that the affidavit that I submitted was "insufficient" Now, I will re-submit an attestation of birth from National Population Commission along with two affidavit from my parents, school records with my name, date of birth and my father's name as the secondary evidence. Do you think that those documents will satisfy the USCIS request?

Hi imsco,

I cannot think of any other documents you can attach apart from those you have listed. One question, were you required to attach birth certificate initially? I have a petition with USCIS too and i didn't not put any of such, just wedding certificate, change of name, the forms, money order and a couple of registry pictures. Do you think they will request for more evidence from me? What set of documents did you submit initially?\

Let me add my two cents. But first two key questions. What is the aos based on? At what is the country of birth?

In both cases the examiner is just at this point filling the blanks. He needs the BC and I would recommend a simple not notarised or anything fancy translation attached to it so he is able to point out who is who and where u fit in the B.c.

Thank you shadowflex and nicja for your response.

The OAS is based on marriage with USC. The country of birth is Nigeria, but i don't need any documents to be translated since they're accurately written in English.

Showdayflex, I can't think of any other documents either, but I was just wondering if there are other document(s) to support my case. Yes it's required if you're filling for I-485 to submit a copy of your birth certificate or affidavit if the birth certificate is not available along with secondary evidence. Check the instructions for I-485 on page 3, 2 "Birth certificate." However, it depends on your country of birth. You can find this information on Department of State's Foreign Affair Manual at www.state.gov

So, upon the above-references, you may get a RFE for your birth certificate as well.

You shouldn't have sent the affidavit from your father originally that doesn't prove anything. They just need the attestation of birth from National Population Commission.

I was not aware of NPC before we filled for AOS. One question for you. Do you ONLY submitted Attestation of Birth from Anational Population Commission without any secondary evidence?
