I-751 October 2013 Filers

I unfortunately received an RFE yesterday :( which only means that I have to wait longer.

They asked for full bank statements I only provided the first page so I don;t overwhelm them with paperwork.. and I guess with our joint taxes we didn't provide the W2's in which case I didn't work that year because I was attending college, and my wife works as a 1099. Also I didn't give them a lease agreement because we don't have one.

Do you suggest I write a letter explaining why we don't have a lease agreement and utility bills? Our primary address is my spouse's parent's house.

I'm also gonna do our taxes this coming week for 2013 and send those as well.

it's disappointing getting this especially when I submitted life insurance policies a ton of pictures and vacation proof together and investment accounts along with 4 affidavits from friends a priest and family.

For the past year, I lived away from my wife because of my college being in CA and her work being in LA. But I'm sure we aren't the only married couple in the world that had to adjust to circumstances. I now graduated and am moving back to live together, just working on setting up a business in Louisiana before I quit my current job. I mean military couples live apart for so many months without even seeing each other regularly.

This sucks.

send all the joint once which cover the entire marriage, it's better.

Quarterly bank statements wil do just fine. And I agree with myafi on tax returns. That's what I sent in with my packet. As for the other evidence, we can provide a better answer, if you can tell us what exactly is written in RFE. I know they tend to be generic but sometimes they give a good idea of what exactly an adjudicator wants to see. And it'll be great if you can list what exactly you guys sent in your original packet.

What the paragraph in the RFE states is

"The conditional permanent resident (CPR) filed a Form I-571 with our office. The (CPR) provided some evidence of marital bona fides. However, the documentation submitted is insufficient because of the following:

1. There was no evidence of a joint residence submitted. 2. The bank statements were incomplete; transaction pages were missing. 3. W-2 forms were not submitted with the tax returns. To establish eligibility for removal of conditional status, it is required that additional documentation be submitted. Documentation should reflect names of both the conditional permanent resident and the U.S citizen spouse. In addition, the documentation should cover the period of time from the date of the marriage to the present date, or the date when the marriage was terminated through divorce, separation, or death. Such examples may include, but are not limited to the following: (HERE THEY LIST EVERYTHING THEY USUALLY LIST WHEN ASKING FOR EVIDENCE)"

The contents of your packet look good with the couple of obvious ones missing (and later asked in RFE). As for the reply to RFE:

1. If you don't have any joint lease document, you can explain that in a letter (no need to elaborate, just the true reason for not having the doc). If you lived with parents, just have them write a sworn affidavit that you guys are living with them from so and so date.

2. Send them quarterly bank statements with transcation pages. They need to know if the account is "active" or not.

3. Tax returns: as mentioned earlier, just request them online from IRS website.

And if there is any additional document that you didn't put together in the original packet (maybe you thought it was trivial/silly), be sure to include that too. You never know what clicks!

As for additional delay, I won't worry about it. I was reading an ex USCIS guy's post the other day, and he said that every morning he tried to first work on RFE cases and make a decision on them (since they are "pending" and their job performance is based on how many cases they got cranked out in addition to other things)

Thank you very much Hy, I will get all these together and then send them out. Hopefully it works out sooner than later. I tend to stress myself over little things even though I know its just formalities.

talked to a former co worker who did ROC last year and said lease/rental agreement is a must. We had no problems with that on our end by they didn't send it the first time, hence they got RFE as well (they even hired a lawyer and let the package go without it, what?!?!).

Lease/ Rental agreement is NOT a must but desirable. There are a lot of people who have been approved with Lease/Rental Agreement.

I checked the copies of the packet that I sent, and I did have a letter of affidavit from my in laws stating in it that we live under their roof. I don't understand why the officer that is checking my file is asking for the three things that I already sent. The tax transcripts are complete and the living arrangement is justified in the affidavit letter. The only thing is the bank statements that I sent were only the first page, and not the complete statement.

I'm just going to write a cover letter and send the same things again. What's the worst that could happen. They will ask for an interview which they will approve the second they look at us.

Hi Gar....sorry about your RFE.

Along with the entire bank statement, I would add an official letter from the bank, which assures that you have an account with them. Just walk in and ask for the letter. I am pretty sure most of the bank can do that for you.

guys today at 10:40 I received email and min later text saying this.

On February 11, 2014, we ordered production of your new card. Please allow 30 days for your card to be mailed to you. If we need something from you we will contact you. If you move before you receive the card, call customer service at 1-800-375-5283.

I am very happy for this and I was expecting RFE but I was lucky I think.thank you all for your support and help.wish same luck with all of you the octuber filers :D
