At the Framboise Patisserie in Middle Village, Queens, the pastries are elegant, the cakes are custom-made — and city officials say the hiring is discriminatory.

“I can’t hire you because you’re black,” Jamilah DaCosta, 25, said she heard when she applied for a job working the counter at the cozy French bake shop.

The Rego Park woman interviewed with co-owner Patty Meimetea in October 2011 but was told she wouldn’t be a good fit for the “counter girl” position because black workers in the front of the store would scare away customers, according to findings by the city Human Rights Commission.

A lot.

Although none that can be attributed to the "failure to employ."

When she walked out of the shop she certainly wasn't in any worse condition than when she walked in, so calculating damages in the normal sense would be difficult.

It's like if my neighbor fails to feed me when I am hungry simply because he does not like my race or religion... did he actually harm me by not feeding me?, Did he add to my pain?

Anyway it seems like a bazar place where people would not frequent a business because a Black person was behind the counter,

but for the sake of argument, lets assume it's true (his business would be harmed) and ask:

SHould a business person be compelled to hire someone if hiring that person might dampen or even ruin his business?

If an "authentic" Japanese Restaurant would be more appealing and do more business with Asian faces on the floor, should he be compelled to employ a weight staff that looked more like the faces on a brochure for the Army?

Might be just the fees and such. Don't know if she is going to seek any other type of compensation.

“Around the Way” is a new application for iPhone and Android users that uses a phone’s GPS to detect your location, then locates the nearest black-owned businesses and gives you step-by-step directions to their door.
More than 20,000 businesses around the country are already listed; a large number of those are located in New York City, particularly Harlem and Brooklyn, but the app’s reach extends pretty far. There is even a listing for a black-owned bed-and-breakfast in Anchorage, Ak.
One of Harlem’s newest black-owned businesses, MIST Harlem, played host to hundreds who attended a launch party for the free app at the theater/restaurant on W. 116th St. last week.
The developers hope to make people as familiar with the app as they are aware of the fact that black-owned businesses in Harlem have become endangered.
Dennis (Denny Moe) Mitchell, owner of Denny Moe’s Superstar Barbershop on Frederick Douglass Blvd., was unaware of the app. After a reporter told him about it, he quickly downloaded it and found his shop listed, with directions and all.
“I think it’s an excellent thing,” Mitchell said. “If it’s going to help out my business, then by all means.”

I guess someone could use that same app to avoid black owned businesses.
