B1/B2 Denied - Applying for R1 Next week

Good day,

I have been going to U.S Since over 2 years ago and I have my brother and my newly wedded wife in U.S

I just got married in U.S about 2 months ago and my wife is a U.S Citizen.

I live in Canada and was just denied an extension of U.S Visa in the consulate because I told the officer my wife is in U.S and just got married some months ago.

He denied me the visa and told me to go and apply for Spousal Visa or K3 Visa if I still want to get an extension.

However, I am planning to get a R1 and K3 Application as I don't have any other option than to file in the application.

This is my question

My U.S Visa is still valid till first week of December 2013. Can I still use it to go to the U.S from Canada and come back before it expire?

I don't want to take a break or vacation at work and later told that I am not able to go to U.S by the boarder services. I am not sure if the officer put any note on the system on my behalf that will make the boarder services deny my entry to the U.S

More also, the officer was aware that I still have a valid visa and do not cancel my visa that is still valid till December.

Please, advise if it is still good for me to go to the U.S and come back before the Visa expiring date

Me: Irish/ Swiss citizen, and now naturalised US citizen. Husband: USC; twin babies born Feb 08 in Ireland and a daughter in Feb 2010 in Arkansas who are all joint Irish/ USC. Did DCF (IR1) in 6 weeks via the Dublin, Ireland embassy and now living in Arkansas.

Canadian citizens don't require a visa, so where are you from?

I am not a Canadian Citizen yet. I am a temporary resident in Canada with a work permit. Awaiting to get a Permanent Resident in Canada in the next few months.

I just did Canadian medical with my wife two months ago in Canada

Why would you apply for an R1 religious staff visa?

I want to apply for the spouse visa and not the religious staff visa.

I am planning to obtain the spousal Visa. While the application is in progress, I will get the K3 Visa which is faster. I will return to Canada when the Spouse Visa has been accepted and completed

CR-1 is what you want. Don't waste your time doing the K-3...

October 18, 2012: Interview (APPROVED)
October 26, 2012: Picked up visa from DHL (delay caused by Sandy)
December 15, 2012: POE Atlanta....................became USC July 2016!!!!

Mothers' Journey (My sister is the petitioner)

September 10, 2013: Sent I-130 (UPS next day service)

September 12, 2013: Received text to confirm delivery

September 16, 2013: Received NOA 1

March 22, 2014: Received NOA 2

April 8, 2014: File Received by NVC

May 26, 2015: Interview (approved)..........now LPR (delays caused by 2 RFE)

A tourist visa simply permits you to apply for entrance. Entrance and duration of stay is never a guarantee

Thank You Everyone. I am in U.S at the moment and was allowed entry through Buffalo US Boarder. I will be submitting my I-130 application tomorrow.
