Who cares???

At this point we still haven't heard anything from Division 8 at Overland park yet, who knows if this division is operating or not. Seems like most of people waiting beyond May has their petition in Overland Park, it would be nice if we hear some/any encouraging news from there.

Who cares? It's still an approval. It means NBC is working and starting to get these out.

My point is that we are starting to see petitions be approved whether from Overland Park, KS or not. This is great news for I-130 filers.

I think we all need to take a chill pill and relax about Overland Park, KS. If the May AILA Meeting is true, then they JUST opened on Monday.

Well, since the topic is regarding Overland Park, may be we should focus on that location. It is great someone got approved recently somewhere else, but it has NOTHING to do with Overland Park.

My point is that we are starting to see petitions be approved whether from Overland Park, KS or not. This is great news for I-130 filers.

I think we all need to take a chill pill and relax about Overland Park, KS. If the May AILA Meeting is true, then they JUST opened on Monday.

Laurel Scott, a (very good) immigration attorney from TX holds weekly chats on her website. Yesterday, I took advantage of it and asked her a question about Overland Park.

1z6xtnn.jpg

(reposting from Sept thread)

Sorry guys for the crappy image sad.png Here's the transcript :

Me: Hi Laurel smile.png Do you know when NBC in Overland Park,KS will become fully operational? They were expected to be by the end of the fiscal year.. Please share if you know anything. I am asking on behalf of all all May, June, July, August and September I-130 filers from VisaJourney!

Laurel: They probably are already actually. We took a took in May and the facility was already done back then- at least for the I-130 adjudication unit. The desks were in place. Carpets put in. Walls painted. They were just doing some final touches. And as I understand it adjudicators were in training at that point. They were supposed to be up and running by fall, which is now.

We don't know there hasn't been any approvals. We only know none of the people on this site have been approved. We are only a very small %. When I was checking cases around mine back in Dec, there was over 900 I130's filed on the same day as me. There was only 82 people on this site from all of Dec.

how long do you guys think to do a backround check???? 2 days? 3 days? 4 days? a week? 2 weeks???? lets say the ovelandpark opened 3 days a... do you guys really think that you would see approvals within 3 days????

It depends... but to setup a background check from scratch can take 1 to 2 months.

For people who file from Abroad, in most cases, they already had the background check done when they did the immigration procedures for their current country of Residence. (see my theory below)

-> In my case, my USC wife had to provide Police reports and other documents to get her French Visa and residence card. I remember,at the time of the processing, before we were granted, that the French immigration officer told us he would do some research before validating her Visa (I an guessing some Interpol background checks and some queries to the US police administration).

On top of that, she already had done some FBI background checks prior to this when we were in Eastern Europe, and as she did no live in the US since then, her US Criminal report should be unchanged.

=> Hence my theory about filers from Abroad: USCIS may expedite these cases, as they may consider, or (even better) see, in their systems that the background check work has already been done. As the USC is living abroad hir/her criminal record should remain unchanged, thus providing a very safe basis for the USCIS officer to grant the NOA2 without having to look deep into the systems. (or having already in the systems a nice, fresh and clean background check already...)

I don't understand why people keep downplaying the importance of the timeline and the amount of people being approved here not reflecting the great scheme of things when in fact it is the opposite.

The people posting in visajourney may be a very small percentage of everyone applying but it CERTAINLY is an accurate percentage of the situation. It's basic mathematics, just like how before elections they take polls from 100 to 200 people and they usually reflect the outcome of the poll.

We have many different types of applications, expedite, DCF, different parts of the USA, and different countries. Mathematically speaking the closer you are to the full pool of petitioners, the more accurate; however, you do not need that many to have a decent estimate.

If for example, one person is approved in May out of 10, we can take that in comparison to the amount of people in the great scheme of things that only about 10% have been approved. And if the real number is 1,000 people have a PD in May it means about 100 people have been approved.

Furthermore this is better than inputting numbers into USCIS status website because we specifically know the details of each application and what service center is going and whether it is going through some weird situation like with the Permanent Resident Spouses at CSC. You get a far more accurate estimate than just having a bunch of I-130 without knowing the background on each.

Yes, this is not an extremely accurate guess, but do not under estimate it as it's all you got and it's not that bad, and while yes there are chances were simply all those in May were extremely unlucky and the estimate there is biased, the odds are very low. It would be like saying you won the lottery 5 times in a row. it is possible, but the odds are very low. Most of the time math and stats are always right and I am sure that any sort of innacuracy in the estimates is corrected by the fact that the majority of the I-130 filers from VJ are doing things right and are actually approved faster than your average joe who forgets to include something and gets an RFE easier than we do.

I know you guys want to panic or try to find hope where there is not by trying to come up with your own guesses, but the truth is VJ is as accurate as you will get so sight tight and most importantly to everyone, update your Timelines and post details if you guys have any changes as that is our strongest weapon in trying to decipher just what USCIS is doing, including this new Service Center.

PS: As for the time it takes for each application to process, as I understood it from that interview with an employee, or ex-employee, of one of the service centers that was posted on VJ some time ago, it took approximately 15 minutes per application (assuming no RFE or any suspicious stuff like having a name that is similar to some criminal) to approve.

Any chances we could call USCIS and maybe beg for some information about this service center? Otherwise unless we see approvals we will have to wait until that meeting in November

Edited by Snipe

Always double check your documents and forms. Not only do you get delayed by RFEs and Checklists, but the time it takes for them to review the new items you send could be used to approve more applications. Save yourself and others valuable time!

If you rely on only 1 event to built your model, you may have errors when counting what could be an exceptionnal event.

-> therefore, I would rather wait to have at leat 2 or 3 approvals to start making statistics

for the rest, I fully agree with your analysis.
