We woke up with the "approved, post-action activity" email this morning.

Again for clarity we are filing from abroad, both of us from France.

We tried to expedite last week (bad parent situation, but not us personally). They said it was not reason for expedite but a tier 2 said just turn the proof in so they could see what exactly are the details. We got the confirmation that they recieved the documents but never heard back. We sent the documents to Lees Summit, but our NOA1 was addressed Overland Park.

Excellent news

filling from France too, but NOA1 end of August.

it is just a matter of days then !

An AILA lawyer who attended the Oct 31 NBC-AILA conference replied to my email inquiry with what's below. There's nothing really new or exciting, and I'm guessing when the official Q&A is posted to uscis.gov, there won't be any game changers there either. Overland Park seems to be DOA.

"As you mentioned the NBC is now routing new stand-alone Forms I-130 to the Nebraska, Texas, and California Service Centers based upon the capacity of the Service Center and not the address of the petitioner. NBC stopped sending stand-alone Forms I-130 to USCIS Field Offices for adjudication in March 2013 and have since been holding them at the NBC. The NBC will also send backlogged stand alone I-130s to the service centers starting with the longest pending cases. Cases that are transferred should receive a transfer notice. The goal is for I-130s to be adjudicated in 5 months but the actual processing time right now is much longer – they are working on cases received on 10/1/2012. Note, however, that all of the service centers are now reporting processing times for immediate relative I-130s so at least we will be able to track USCIS progress on these cases whereas before we had no clue what was going on."

I called the NBC yesterday and spoke to a first tier person (ha! that was funny. $8 an hour? and relatively clueless) who said that the backlog for CR1's is 13 months (which you can read on the USCIS site). I think a small portion of that is relevant to the shutdown, but most of it is probably due to being understaffed and focusing on other non CR1 cases. IMO the excess CR1 backlog will cause someone to focus on getting that up to a more reasonable time frame, but how long will it take for them actually decrease the backlog? I also believe that the focus from the Administration on Immigration Reform (naturalizing illegal citizens) is also occupying CIS cycles, and pushing back the time frame for the people who are trying to comply with the law and bring their spouses/relatives here legally.

Will all files originally sent to Overland Park get transferred?

New petitions are being routed directly to Nebraska, lately. It seems Overland Park is not and will not be fully operational.

Does that lawyer have any knowledge on this?

None of the illegals wanted to file an I-130 because they knew they would have to leave and wait for the waiver to be processed. I guess for fear that the US would know they were here and if they didn't leave to wait for the waiver , they might be deported or something. But now they are free to wait here in the US while the waiver is processed. Which kind of irritates me too. But we are all suffering because of the rush of petitions no matter what the cause.

None of the illegals wanted to file an I-130 because they knew they would have to leave and wait for the waiver to be processed. I guess for fear that the US would know they were here and if they didn't leave to wait for the waiver , they might be deported or something. But now they are free to wait here in the US while the waiver is processed. Which kind of irritates me too. But we are all suffering because of the rush of petitions no matter what the cause.

That, and DACA also have to file I-130.

Their I-130s are also approved faster. (from what I see on immigrate2us.net, a forum for "complicated" cases)

Good morning Blueberry, I wonder if you might help me understand something. When I check Igor's list for approved I-130/IR1/CR1 Visa's it shows way more petitions being approved from NBC than Nebraska, Texas and California. Isn't NBC the same as Overland Park? If not, where is it now?

All I-130 petitions used to be processed at the service centers, until August 15,2012 when petitions started being routed directly to NBC and then to local offices. Some cases stayed at the NBC/Lee's Summit, MO though.

However, USCIS stopped transferring files to local offices sometime this year.

There are two NBCs now. One in Lee's Summit, MO and one in Overland Park, KS.

So,

1. Until August 15, 2012 - Chicago/Phoenix Lockbox-> Nebraska Service Center, Vermonet Service Center, California Service Center, Texas Service Center

2. Aug 15,2012- March (?) 2013- Chicago/Phoenix Lockbox-> NBC/Lee's Summit, MO-> local offices (some stayed at NBC). !!! Now, Feb and March files are being transferred to the service centers.

3. May 2013- end of Oct 2013- Chicago/Phoenix Lockbox- > NBC/Overland Park, KS (not fully operational yet)

4. Starting end of Oct 2013- Chicago/Phoenix Lockbox-> service centers (although I only saw Nebraska)

AILA liaison response to my follow-up NBC question:

"I believe they are transferring cases on a rolling basis so while Feb. and Mar. files are being transferred now, I imagine we will see April, May, and June moving soon. However, USCIS is constantly reviewing and reevaluating workload distribution so it is possible that things could change again. I also understand that some petitions will remain at NBC for adjudication, which, again, is all a part of the workload-balance thing.

Once the committee pulls together their collective notes, there may be some additional insights to share."

It seems nothing explicit on this issue was stated in the meeting, so these are the lawyer's own thoughts, which boil down to: anyone waiting over 5 months right now is likely to be moved. Has anyone made note of how long it took from the beginning of Feb transfers to the beginning of March transfers? Perhaps that will give us an idea of when we might look out for our own notices. Approval rates compared to number of transfers is depressingly low, though.
