I-485 & I-94 question (PLZ HELP...Thank you)

I am currently here in the US under an H1B, and just married my girlfriend of long time. I am currently preparing the I-485, however, I have been arrested earlier this year (march) with regards to a DUI. I was released without bail and immediately hired a lawyer to defend me. My DUI case is still pending and my court date is scheduled for end of January 2014. In the meantime, we are going to be filing these documents within the next two weeks.

As such, I was wondering what documents I should provide as evidence (as per the I-485 instructions) in the packet I am sending. Any ideas?

Furthermore, having been finger printed as part of my arrest, will I have to be re-fingerprinted as part of the I-485 application?

Lastly, I came back from Europe (which is where I am from) this summer after visiting my family and it appears that they stopped using the I-94 as of earlier this year. As a results, what evidence should I include in the packet and what should I put in the I-130 form?

You will have to be fingerprinted, yes. And per the arrest, I would send copies of any and all documents relating to it, plus a sheet of explanation and timeline for your hearings.

Were you arrested in America for a DUI? Oh boy! My husband was arrested in 2008 in Netherlands and he in the interview got sent to AP and had to go to medical exam in Amsterdam. America does not take lightly to immigration and drinking and Driving. You might need a good immigration lawyer as well... I wish you well

I was indeed arrested in the US for my DUI. I know that they take it extremely seriously, but being the first offence ever, I was told it should be OK. Now that you brought the medical exam, can I do that here being that I am under an H1 and I was told that once you submit the I-485 it is recommended that you DO NOT leave the country.
